trade in them, and the usage of vessels is prohibited absolutely in drinking, eating, and other activities, because the text mentions the prohibition of drinking and eating, and other activities are equivalent in meaning.
This is prohibited for both men and women due to the generality of the text regarding both of them and the existence of the meaning of prohibition in their regard. The adornment was only permitted for women due to their need to beautify themselves for their husbands and to adorn themselves for them, and this is specific to jewelry, so the permissibility is specific to that.
Section: As for that which is repaired (mudhabbab)(8) with gold or silver, if it is in a large amount, it is prohibited in all cases, whether it is gold or silver, and whether it is for a need or otherwise. This is the opinion of al-Shafi'i.
Abu Hanifa permitted that which is repaired, even if it is in a large amount, because it has become subordinate to the permitted, so it is like that which is repaired with a small amount.
Our argument is that this contains extravagance and arrogance, so it is like the pure [material]. What he said is invalidated by [the case] where one makes doors out of silver or gold, or shelves, as it is prohibited even if it is subordinate, and it differs from the small amount, as the prohibited meaning is not present in it.
Once this is established, our companions differed; Abu Bakr said: A small amount of gold and silver is permitted for the reason we mentioned. Most of our companions are of the opinion that a small amount of gold is not permitted, and nothing is permitted of it except that to which necessity calls, such as a nose of gold or what he uses to fasten his teeth(10).
As for silver, a small amount of it is permitted, based on what Anas narrated, that the cup of the Prophet (may Allah bless him and grant him peace) broke, and he took a chain of silver in place of the crack. Al-Bukhari narrated it(11); and because necessity calls for it, and it does not contain extravagance or arrogance, so it is like a repair made of brass(12). The Qadi said:
(8) Al-mudhabbab: that which has been made with a repair (dabba) of iron, brass, or other materials with which it is mended. (9) In [Manuscript] M: "or it differs". (10) Omitted from: M.
