place it between his heels or between his fingers and wipe his penis upon it, he should do so. If he cannot, he should hold it with his right hand and wipe with his left due to the requirement of necessity. It is said: He should hold his penis with his right hand and wipe with his left so that the wiping is done with something other than the right hand. The first view is more appropriate due to the saying of the Prophet -may Allah bless him and grant him peace-: "None of you should hold his penis with his right hand." If he holds the stone with his right hand and wipes the penis upon it, he has neither wiped with the right hand nor held the penis with it. If he is missing his left hand or it is afflicted with an illness, he should perform istijmar with his right hand due to necessity. It is not disliked to seek assistance with the right hand in using water, because necessity requires it. If he performs istijmar with his right hand when there is no need for it, it is valid according to the view of the majority of scholars. It has been narrated from some of the Zahiris that it is not valid, because it is something forbidden, and thus it does not fulfill its purpose, just as if one were to perform istinja' using dung or bones, as the prohibition covers both. The difference between them is that dung is an instrument of istijmar that comes into direct contact with the area and is a condition for it, so it is not permitted to use a forbidden item for it, whereas the hand is neither the instrument in direct contact with the area nor a condition for it; rather, one uses it to hold the stone that comes into contact with the area. Thus, the prohibition regarding it is a prohibition of discipline, which does not prevent validity.

Section: A man should begin istinja' with the front passage so that his hand does not become soiled when he proceeds to the back passage, because his front passage is exposed and the hand will touch it when he extends it toward the back passage. A woman has the choice to begin with whichever she wishes, because she does not have that issue.

It is recommended to remain for a little while after urinating and to place one's hand at the base of the penis from underneath the testicles, then draw it toward the tip, and then flick (14) his penis three times gently. Ahmad said: "When you perform wudu', place your hand at your lower part, then draw what is there until it descends, and do not make that a concern of yours, and do not pay attention to your doubts." It has been narrated by Yazdad al-Yamani who said: The Messenger of Allah -may Allah bless him and grant him peace- said: "If one of you urinates, let him flick his penis three times." [Reported by Imam Ahmad] (15).

يَضَعَه بين عَقِبَيْه، أو بين أصابِعهِ، ويَمْسَح ذَكَرَه عليه، فَعَلَ، وإن لم يُمْكِنْه، أمْسَكَه بيَمِينه، ومَسَح بيَسَارِه؛ لموضِعِ الحاجةِ. وقيل: يُمْسِك ذَكَرَه بيَمِينه، ويَمْسَح بشِمَالِه؛ ليكونَ المَسْحُ بغيرِ اليَمينِ. والأَوَّلُ أَوْلَى؛ لقَوْلِ النبيِّ -صلى اللَّه عليه وسلم-: "لا يُمْسِكَنَّ أحَدُكُمْ ذَكَرَهُ بِيَمينِه". وإذا أمْسَكَ الحَجَرَ باليَمينِ، ومَسَحَ الذَّكَرَ عليه، لم يكن ماسِحًا باليَمينِ، ولا مُمْسِكًا للذَّكَرِ بها، وإنْ كان أقْطَعَ اليُسْرَى، أو بها مَرَضٌ، اسْتَجْمَرَ بِيَمينِه؛ للحاجةِ. ولا يُكْرَه الاسْتِعانةُ بها في الماءِ؛ لأن الحاجةَ داعيةٌ إليه. وإن اسْتَجْمَرَ بِيَمينِهِ مَع الغِنَى عنه، أجْزَأَهُ في قَوْلِ أكْثرِ أهْلِ العِلْمِ. وحُكِىَ عن بعض أهلِ الظاهرِ أنَّه لا يُجْزِئُه؛ لأنَّه مَنْهِيٌّ عنه، فلم يُفِدْ مَقْصُودَه، كما لو اسْتَنْجَى بالرَّوْثِ والرِّمَّةِ، فإنَّ النَّهْىَ يتناولُ الأمْرَيْن، والفَرْقُ بينهما أن الرَّوْثَ آلةُ الاسْتِجْمارِ المُباشِرةُ للمَحَلِّ وشَرْطُه، فلم يَجُز اسْتِعْمالُ المَنْهِىِّ عنه فيها، واليدُ ليست المُباشرةَ للمَحَلِّ ولا شَرْطا فيه، إنَّما يتناوَلُ بها الحَجَرَ المُلَاقِى للمَحَلِّ، فصار النَّهْىُ عنها نَهْىَ تأْديبٍ، لا يَمْنَعُ الإِجْزَاءَ.

فصل: ويبدأُ الرَّجُلُ في الاسْتِنْجاءِ بالقُبُلِ؛ لِئَلَّا تَتَلَوَّثَ يدُه إذا شَرَعَ في الدُّبُرِ، لأنَّ قُبُلَه بارزٌ تُصِيبُه اليدُ إذا مَدَّها إلى الدُّبُرِ. والمرأةُ مُخَيَّرةٌ في البدايةِ بأَيِّهما شاءتْ، لعَدَمِ ذلك فيها.

ويُسْتَحَبُّ أن يَمْكُثَ بعدَ البَوْلِ قليلًا، ويَضَعَ يَدَهُ على أصْلِ الذَّكَرِ من تحتِ الأُنْثَيَيْن، ثم يَسْلِتَه إلى رَأْسِه فيَنْتُر (١٤) ذَكَرَه ثلاثًا برِفْقٍ. قال أحمد: إذا تَوَضَّأْتَ فضَعْ يَدَك في سِفْلَتِكَ، ثم اسْلِتْ ماثَمَّ حتَّى يَنْزِلَ، ولا تجعلْ ذلك مِن هَمِّكَ، ولا تَلْتفِتْ إلى ظَنِّك. وقد رَوَى يَزْدادُ اليَمانِىُّ، قال: قال رسولُ اللَّه -صلى اللَّه عليه وسلم-: "إذا بالَ أحَدُكم فَلْيَنْتُرْ ذَكَرَه ثَلاثَ مَرَّاتٍ". [رَواه الإمامُ أحمدُ] (١٥).
