What they mentioned regarding the ghusl is not conceded; for it is said: "He washed the vessel," even if he did not pass his hand over it (13), and a large flow of water is called a "ghasul" (14). In Tayammum, we have been commanded to wipe, because it is a purification with dust, and it is usually impossible to pass the dust over the body except with the hand. If it is said: "But this hadith does not mention the intention, which is obligatory, nor rinsing the mouth and sniffing water, which are obligatory according to you." We say: As for the intention, she asked him about the ghusl (15) for Janaba, and there is no ghusl for Janaba except with intention. As for rinsing the mouth and sniffing water, they have entered into its generality, due to his saying: "Then pour water over yourself," and the mouth and nose are part of it.

فيه إمْرَارُ اليدِ، كغَسْلِ النَّجَاسَةِ (١٢)، وما ذَكَرُوهُ في الغُسْلِ غير مُسَلَّمٍ؛ فإنَّه يُقَالُ: غَسَلَ الإِناءَ. وإن لم يُمِرَّ فيه (١٣) يَدَهُ، ويُسَمَّى السَّيْلُ الكبيرُ غَاسُولًا (١٤)، والتَّيَمُّمُ أُمرْنا فيه بالمَسْحِ؛ لأنَّه طَهَارَةٌ بالتُّرَابِ، ويَتَعَذَّرُ في الغالِبِ إمْرَارُ التُّرَابِ إلَّا باليدِ. فإنْ قِيلَ: فهذا الحديثُ لم تُذْكَرْ فيه النِّيَّةُ، وهي وَاجِبَةٌ، ولا المَضْمَضَةُ والاسْتِنْشَاقُ، وهما وَاجِبَانِ عندَكم. قلنا: أَمَّا النِّيَّةُ فإنَّها سَأَلَتْهُ عَن غُسْلِ (١٥) الجَنَابَةِ، ولا يكونُ الغُسْلُ لِلجنابةِ إلَّا بالنِّيَّةِ، وأمَّا المَضْمَضَةُ والاسْتِنْشَاقُ فقد دَخَلَا في عُمُومِه؛ لقَوْلِه: "ثُمَّ تُفِيضِينَ عَلَيْكِ الماءَ". والفَمُ والأَنْفُ مِنْ جُمْلَتِها.

فصل: ولا يَجِبُ التَّرْتِيبُ ولا المُوَالَاةُ في أَعْضَاءِ الوُضُوءِ إذا قُلْنَا الغُسْلُ يُجْزِىءُ عنهما؛ لأنَّهما عبادتانِ دَخَلَتْ إحْدَاهُما في الأُخْرَى، فَسَقَطَ حُكْمُ الصُّغْرَى، كالعُمْرَةِ مع الحَجِّ. نَصَّ على هذا أحمدُ، قال حَنْبَل: سَأَلْتُه عَنْ جُنُبٍ اغْتَسَلَ وعليه خَاتَمٌ ضَيِّقٌ؟ قال: يَغْسِلُ مَوْضِعَ الخَاتَم. قلتُ: فإنْ جَفَّ غُسْلُه؟ قال: يَغْسِلُه، ليس هوَ بمَنْزِلَةِ الوضوءِ، الوضوءُ مَحْدُودٌ، وهذا على الجُمْلَةِ، قالَ اللهُ تَعالَى: {وَإِنْ كُنْتُمْ جُنُبًا فَاطَّهَّرُوا (١٦)} قُلْتُ: فإنْ صَلَّى ثم ذَكَرَ؟ قال: يَغْسِلُ مَوْضِعَه، ثُمَّ يُعِيدُ الصَّلَاةَ. وأكثرُ أَهْلِ العِلْمِ لا يَرَوْنَ تَفْرِيقَ الغُسْلِ مُبْطِلًا له، إلَّا أَنَّ رَبيعةَ قال: مَنْ تَعَمَّدَ ذَلِكَ فأَرَى عليه أنْ يُعِيدَ الغُسْلَ. وبه قال اللَّيْثُ. واخْتَلَفَ (١٧) فيه عَنْ مَالِكٍ، وفيه وَجْهٌ لأَصْحَابِ الشَّافِعِيِّ. وما عليه الجُمْهُورُ
