because it is the certainty, and if we did not make her sit for that, it would lead to us not making her sit at all; and because she is someone who has no habit and no discernment (tamyiz), so she does not sit for the maximum duration of menstruation, like the one who has forgotten.

Section: The textual requirement (al-mansus) regarding the beginner (al-mubtada'ah) is to consider repetition [of the occurrence] three times. Based on this, she does not move away from certainty in the third month. It has been explicitly stated regarding the one with a habit who sees blood in excess of her habit that she sits for the additional [days] twice, in one of the two narrations from him, so it is the same here, and their reasoning has already passed. According to all the narrations, if the blood ceases at the maximum duration of menstruation or less, and it was at the same amount for three months, she moves to it, acts upon it, and that becomes a habit for her. She must repeat [the prayers] she fasted of the obligatory [fasts] during that time because it became clear to us that she fasted while in her menstruation.

Section: If it ceases during the three months differently—in one month it ceases on the seventh [day], in one month on the sixth, and in one month on the fifth—she looks to the least of that, which is the fifth, and considers it menstruation, [and whatever exceeds it is not menstruation], until the repetition occurs for it. He explicitly stated this. If it comes in the fourth month as six or more, the six becomes menstruation due to it having been repeated three times, and the same rule applies to the seventh if it is repeated three times. Whoever said that she should sit for six or seven [days], [is of the view that] she sits for that without repetition, and she does not sit for what exceeds it until it is repeated. For this reason, whoever makes her sit according to the habit of the women of her family makes her sit according to what matches their habit, without repetition.

Section: Whenever we make her sit for a day and a night, or six or seven, or the habit of the women of her family, and she sees blood more than that, it is not lawful for her husband to have intercourse with her during it until it ceases, or it exceeds the maximum duration of menstruation; because it is likely to be menstruation with a strong probability. We only ordered her to fast and pray during it as a precaution for the discharge of her responsibility, so it is obligatory to abandon intercourse with her as a precaution as well. If the blood ceases and she performs ghusl, intercourse with her becomes lawful. Is it disliked? There are two narrations: One of them is that it is not disliked, because she has seen pure discharge, similar to someone other than the beginner. The second is that it is disliked, because we cannot be certain that the blood will not return, so intercourse with her is disliked, like the woman in postpartum bleeding if her blood ceases in less than forty days. فصل: والمَنْصُوصُ في المُبْتَدَأَةِ اعْتِبارُ التَّكْرَارِ ثلاثًا، فعلى هذا لا تَنْتَقِلُ عن اليَقِينِ في الشهرِ الثَّالِثِ، وقد نَصَّ في المُعْتَادَةِ تَرَى الدَّمَ زِيَادَةً على عَادَتِها على جُلُوسِها الزَّائِد بِمَرَّتَيْنِ، في إحْدَى الرِّوَايَتَيْنِ عنه، فكذا ههنا، وقد مَضَى تَوْجِيهُهُما. وعلى الرِّوَايَاتِ كُلِّها، إذا انْقَطَعَ الدَّمُ لأكْثَرِ الحَيْضِ فما دُونَ، وكان في الأشْهُرِ الثَّلَاثَةِ على قَدْرٍ وَاحِدٍ، انْتَقَلَتْ إليه، وعَمِلَت عليه، وصارَ ذلك عَادَةً لها، وأعَادَتْ ما صَامَتْهُ مِن الفَرْضِ فيه؛ لأنَّنا تَبَيَّنَا أنَّها صَامَتْهُ في حَيْضِها.

فصل: وإنِ انْقَطَعَ في الأشْهُرِ الثَّلَاثةِ مُخْتَلِفًا، ففى شَهْرٍ انْقَطَعَ على سَبْعٍ، وفى شَهْرٍ على سِتٍّ، وفى شَهْرٍ على خَمْسٍ، نَظَرَتْ إلى أقَلِّ ذلك، وهو الخَمْسُ، فجَعَلَتْه حَيْضًا، [وما زاد عليه لا يكونُ حيضًا] (٤)، حتى يَأْتِىَ عليه التَّكْرَارُ. نَصَّ عليه. وإنْ جاء في الشهرِ الرَّابِعِ سِتًّا أو أكْثَرَ، صارتِ السِّتَّةُ حَيْضًا؛ لتَكْرَارِها (٥) ثلاثًا، وكذلك الحُكْمُ في السَّابعِ إذا تَكَرَّرَ ثلاثًا. ومَنْ قال بِإِجْلاسِها سِتًّا أو سَبْعًا، فإنَّها تجلسُ ذلك مِنْ غير تَكْرَارٍ، ولا تَجْلِسُ ما زاد عليه حتى يَتَكَرَّرَ، ولذلك مَنْ أجْلَسَها عَادَةَ نِسَائِها، فإنَّهُ يُجْلِسُها ما وَافَقَ عَادَتَهُنَّ، مِنْ غيرِ تَكْرَارٍ.

فصل: ومتى أجْلَسْنَاها يومًا وليلةً، أو سِتًّا أو سَبْعًا، أو عَادَةَ نِسَائِها، فرَأَتِ الدَّمَ أكْثَرَ مِن ذلك، لم يَحِلَ لِزَوْجِها وَطْؤُها فيه حتى يَنْقَطِعَ، أو يَتَجَاوَزَ أكْثَرَ الحَيْضِ؛ لأنَّهُ يَحْتَمِلُ أن يكونَ حَيْضًا احْتِمَالًا ظاهِرًا، وإنَّما أمَرْنَاهَا بالصَّوْمِ فيه والصَّلَاةِ احْتِيَاطًا لِبَرَاءَةِ ذِمَّتِها، فيَجِبُ تَرْكُ وَطْئِها احْتِيَاطًا أيضًا. وإنِ انْقَطَعَ الدَّمُ، واغْتَسَلَتْ، حَلَّ وَطْؤُها. وهل يُكْرَهُ؟ على رِوَايَتَيْنِ: إحْدَاهُما، لا يُكْرَهُ؛ لأنَّها رَأَتِ النَّقَاءَ الخَالِصَ، أشْبَهَ غيرَ المُبْتَدَأَةِ. والثَّانِيةُ، يُكْرَهُ؛ لأَنَّنا لا نَأْمَنُ مُعَاوَدَةَ الدَّمِ، فَكُرِهَ وَطْؤُها، كالنُّفَسَاءِ إذا انْقَطَعَ دَمُها لأَقَلَّ مِنْ أربعين يومًا. فإنْ عَاوَدَها
