Volume 1 · Page 46997 - Issue: He said: (Yellowish and turbid discharge during the days of menstruation counts as menstruation.)

Translation · EN

in the second month, he said that she sits [refraining from prayer] during the black blood in the third month, because she does not know that she is a possessor of discernment (mumayyiza) before that. If she saw in a month five [days] black, then it became red and was continuous, and in the second [month] the same, and in the third [month] it was all red, and in the fourth she saw five [days] red, then it became black and was continuous, she sits [during] the time of certainty in the three months, and in the fourth, she has no discernment, so she reverts in it to six or seven days, according to the most famous of the narrations, unless we say: A habit is established by two occurrences, so she sits during the third and fourth months five [days] by five [days]. The Qadi said: She does not sit in the four months except for the [duration of] certainty. This is far-fetched, due to what we have mentioned. If she had seen in the fourth [month] five [days] black, and the rest was all red, it would have become a habit by that.

97 - Issue: He said: (And the yellow discharge and the turbid discharge during the days of menstruation are part of the menstruation).

Meaning: If she sees during the days of her habit a yellow or turbid discharge, it is menstruation. If she sees it after the days of her menstruation, it is not counted. Ahmad has explicitly stated this, and Yahya al-Ansari, Rabi'ah, Malik, al-Thawri, al-Awza'i, 'Abd al-Rahman ibn Mahdi, al-Shafi'i, and Ishaq have held the same view. Abu Yusuf and Abu Thawr said: It is not menstruation unless it is preceded by black blood, because Umm 'Atiyya—who pledged allegiance to the Prophet (peace and blessings of Allah be upon him)—said: "We used not to count the yellow and turbid discharge after the ghusl as anything." It was narrated by Abu Dawud, who said: "After the period of purity." Our evidence is the saying of the Almighty: "And they ask you about menstruation; say, 'It is an impurity'" (Quran 2:222), and this encompasses both yellow and turbid discharge. Al-Athram narrated with his chain of transmission from 'Aisha, may Allah be pleased with her, that women used to send her a container (durjah) containing cotton...
