containing yellow and turbid discharge, and she would say: "Do not hasten until you see the white discharge," meaning by that the purity from menstruation. The hadith of Umm 'Atiyya only encompasses what is after purity and performing ghusl, and we hold the same view. 'Aisha has also said: "We used not to consider turbid and yellow discharge as menstruation," along with her previous statement that we have already mentioned.

Section: The ruling on yellow and turbid discharge is the same as the ruling on fresh blood in that it is menstruation if it occurs during the days of menstruation, and the beginner [in menstruation] sits [refraining from prayer] due to it just as she sits due to other [discharges]. If she sees it after the habitual period, it is as if she saw something else, according to what will be mentioned later, if Allah wills. If she becomes pure and then sees a turbid or yellow discharge, it is not given any consideration, due to the report of Umm 'Atiyya and 'Aisha. Al-Najjad narrated with his chain of transmission from Muhammad ibn Ishaq, from Fatima, from Asma', who said: "We were in her care with her daughter’s daughters, and one of us would become pure then pray, then she would be afflicted with a slight yellow discharge. We would ask her, and she would say: 'Withdraw from prayer until you see nothing but pure white.'" The first [view] is more appropriate due to what we have mentioned, and the statement of 'Aisha and Umm 'Atiyya is more appropriate than the statement of Asma'. The Qadi said: The meaning of this is that she does not pay attention to it before [the habit] is repeated, and the statement of Asma' is in the case where it has been repeated, thus reconciling between the reports. And Allah knows best.

98 - Issue: He said: (And one may enjoy the menstruating woman [in ways] other than the vagina.)

The summary of this is that enjoyment of a menstruating woman above the navel and below the knee is permissible by text and consensus, and sexual intercourse in the vagina is forbidden by both. There is disagreement regarding the enjoyment of what is between them;

فيها الصُّفْرَةُ والْكُدْرَةُ، فتقولُ: لا تَعْجَلْنَ حتى تَرَيْنَ القَصَّةَ البَيْضَاءَ (٤) تُرِيدُ بذلك الطُّهْرَ مِن الحَيْضَةِ. وحديثُ أُمِّ عَطِيَّة إنَّما يتَنَاوَلُ ما بعدَ الطُّهْرِ والاغْتِسالِ، ونحن نقولُ به، وقد قالتْ عائشةُ: ما كُنَّا نُعِدُّ الكُدْرَةَ والصُّفْرَةَ حَيْضًا (٥). مع قَوْلِها المُتَقَدِّمِ، الذي ذَكَرْنَاه.

فصل: وحُكْمُ الصُّفْرَةِ والْكُدْرَةِ حُكْمُ الدَّمِ العَبِيطِ (٦) في أنَّها في أيَّامِ الحَيْضِ حَيْضٌ، وتَجْلِسُ مِنْها المُبْتَدَأةُ كما تَجْلِسُ مِن غيرِها. وإنْ رَأتْها فيما بعدَ العادَةِ فهو كما لو رَأتْ غيرَها على ما سيأتى ذِكْرُه، إنْ شاء اللهُ. وإنْ طَهُرَتْ ثم رَأَتْ كُدْرَةً أو صُفْرَةً، لم يُلْتَفَتْ إليها؛ لِخَبَرِ أُمِّ عَطِيَّة وعائشةَ، وقد رَوَى النَّجَّادُ (٧)، بإسْنَادِه، عن محمدِ بنِ إسحاقَ، عن فاطمَةَ، عن أَسْمَاءَ قالتْ: كُنَّا في حِجْرِها مع بَنَاتِ بِنْتِها (٨)، فكانتْ إحْدَانا تَطْهُرُ ثم تُصَلِّى، ثم تُنْكَسُ بالصُّفْرَةِ اليَسِيرَةِ، فنَسْأَلُها، فتقولُ: اعْتَزِلْنَ الصَّلَاةَ حتى لا تَرَيْنَ إلَّا البَيَاضَ خَالِصًا. (٩) والأوَّلُ أَوْلَى؛ لِمَا ذَكَرْنا، وقولُ عائِشَةَ وأُمِّ عَطِيَّة أوْلَى مِنْ قولِ أَسْمَاءَ. وقال القاضي: مَعْنَى هذا أنَّها لا تَلْتَفِتُ إليه قَبْلَ التَّكْرَارِ، وقولُ أَسْمَاءَ فيما إذا تَكَرَّرَ، فجَمَعَ بينَ الأخْبَارِ. واللهُ أعلمُ.

٩٨ - مسألة؛ قال: (ويُسْتَمْتَعُ مِنَ الحائِضِ بِمَا دُونَ الفَرْجِ)

وجُمْلَتُه أنَّ الاسْتِمْتَاعَ مِن الحائِضِ فيما فوقَ السُّرَّةِ ودونَ الرُّكْبَةِ جَائِزٌ بالنَّصِّ والإِجْماعِ، والوَطْءُ في الفَرْجِ مُحَرَّمٌ بهما. واخْتُلِفَ في الاسْتِمْتَاعِ بما بَيْنَهُما؛
