If he accuses her of adultery (qadhf), it is not a choice for her; because it occurs toward someone who is not a wife.
Section: If he chooses four of them and separates from the rest, their waiting period ('iddah) begins from the time he chooses; because they have been separated from him by the choice. It is possible that their waiting period begins from the time he converted to Islam; because they were separated by his conversion, and this is only clarified by his choice, so its ruling is established from the time of conversion, just as when one of two spouses converts to Islam and the other does not until her waiting period has ended. Their separation is an annulment (faskh); because it is established by his conversion without any utterance regarding them, and their waiting period is like the waiting period of the divorced women; because the waiting period of one whose marriage is annulled is as such. If one of the chosen women dies, or is separated from him and her waiting period ends, he may marry one of the women who were separated, and she would be with him on the basis of three divorces; because he did not divorce her before that. If he chooses fewer than four, or chooses to leave all of them, he is commanded to divorce four, or to complete four; because the four wives are not separated from him except by divorce, or what takes its place. So, when he divorces four of them, his divorce of them takes effect, and the marriage of the remaining ones is annulled due to his choice for the [others], and the waiting period of the divorced women is from the time he divorced, while the waiting period of the remaining ones follows the two [mentioned] views. If he divorces all of them, lots are cast among them, so if the lot falls on four of them, they are the chosen ones, his divorce of them takes effect, and the marriage of the remainder is annulled. If the divorce was three, then whenever their waiting period ends, he may marry any of the remaining ones; because they were not divorced by him, and the divorced women are not permissible for him except after another husband and consummation. If he converted to Islam, then divorced everyone before they converted to Islam, then they converted during the waiting period, he is commanded to choose four of them. وإن قَذَفَها، لم يَكُنِ اخْتيارًا لها؛ لأنَّه يَقَعُ فى غيرِ زَوْجةٍ.
فصل: وإذا اخْتارَ منهنَّ أرْبعًا، وفارَقَ البَواقِىَ، فعِدَّتُهُنَّ من حينَ اخْتارَ؛ لأنَّهُنَّ بِنَّ منه بالاخْتيارِ. ويَحْتَمِلُ أن تكونَ عِدّتُهن من حِينَ أسْلَمَ؛ لأنَّهنَّ بِنَّ بإسْلامِه، وإنما يَتَبَيَّنُ ذلك باخْتِيارِه، فيَثْبُتُ (٢٣) حُكْمُه من حينِ الإِسْلامِ، كما إذا أَسْلَمَ أحدُ الزَّوْجَيْنِ ولم يُسْلِمِ الآخَرُ حتى انْقَضَتْ عِدَّتُها. وفُرْقتهُنَّ فَسْخٌ؛ لأنَّها تَثْبُتُ بإسْلامِه من غير لَفْظٍ فِيهنَّ (٢٤)، وعِدّتُهنَّ كعِدَّةِ المُطَلَّقاتِ؛ لأنَّ عِدَّةَ مَن انْفَسَخَ نِكاحُها كذلك. وإن ماتَتْ إحْدَى المُخْتاراتِ، أو بانَتْ منه وانْقَضَتْ عِدّتُها، فله أن يَنْكِحَ من المُفارَقاتِ، وتكونُ عندَه على طَلاق ثلاثٍ؛ لأنَّه لم يُطَلِّقْها قبلَ ذلك. وإن اختارَ أقَلَّ من أرْبَعٍ، أو اختارَ تَرْكَ الجميعِ، أُمِرَ بطَلَاقِ أرْبَعٍ، أو تمامِ أرْبعٍ؛ لأنَّ الأَرْبَعَ الزَّوْجاتِ لا يَبِنَّ منه إلَّا بطَلَاقٍ، أو ما يقومُ مَقامَه، فإذا طَلَّقَ أرْبعًا منهنَّ، وَقَعَ طَلَاقُه بِهِنَّ، وانْفَسَخَ (٢٥) نِكاحُ الباقياتِ، لاخْتِيارِه لَهُنَّ، وتكونُ عِدَّةُ المُطلَّقاتِ من حينَ طَلَّقَ، وعِدَّةُ الباقياتِ على الوَجْهَيْنِ. وإن طَلّقَ الجميعَ، أُقْرِعَ بينهنَّ، فإذا وَقَعَتِ القُرْعةُ على أرْبعٍ منهنَّ، كُنَّ المُخْتاراتِ، ووَقَعَ طلاقُه بِهِنَّ، وانْفَسَخَ نِكاحُ البَوَاقِى. وإن كان الطَّلاقُ ثلاثًا، فمتى انْقَضَتْ عِدَّتُهنَّ، فله أن يَنْكِحَ من الباقياتِ؛ لأنَّهُنَّ لم يُطَلَّقْنَ منه، ولا تَحِلُّ له المُطلَّقاتُ إلَّا بعدَ زَوْجٍ وإصابةٍ. ولو أسْلَمَ، ثم طَلَّقَ الجميعَ قبلَ إسْلامِهِنَّ، ثم أسْلَمْنَ فى العِدَّةِ، أُمِرَ أن يختارَ أربعًا منهنَّ، فإذا اختارَهُنَّ تَبَيَّنَّا أَنَّ طَلَاقَه وَقَعَ بهِنَّ؛ لأنَّهُنَّ زَوْجاتٌ، ويَعْتَدِدْنَ (٢٦) من حينِ طَلَاقِه، وبانَ البَواقِى منه (٢٧) باخْتِيارِه لغيرِهِنَّ، ولا يَقَعُ بهنَّ طَلَاقُه، وله نِكاحُ أربَعٍ منهنَّ إذا انْقَضَتْ عِدَّةُ المُطلَّقاتِ؛ لأنَّ
