Translation · EN

"What is the matter with people who play with the boundaries of Allah and mock His verses, saying: 'I have divorced you,' 'I have taken you back,' 'I have divorced you.'" In a wording narrated by Ibn Battah: "I have khul' (separated) you, and I have taken you back, I have divorced you, I have taken you back." He also narrated with his chain of authority from Abu Hurayrah, who said: The Messenger of Allah (may Allah bless him and grant him peace) said: "Do not commit what the Jews committed, so that you make lawful the prohibited things of Allah by the slightest of ruses."

Section: If the condition does not return after the second marriage, such as if he said: "If you eat this loaf of bread, you are divorced three times." Then he separates from her, and she eats it, then he marries her, he does not commit a breach; because his breach is by the existence of the condition within the second marriage, and it was not found, and it is not possible to effectuate the divorce by her eating it during the state of separation, because divorce does not attach to a separated woman. And Allah the Exalted knows best.

"مَا بَالُ أَقْوَامٍ يَلْعَبُوْنَ بِحُدُوْدِ اللَّهِ، وَيَسْتَهْزِئُوْنَ بِآيَاتِهِ: قَدْ طَلَّقْتُكِ، قَدْ رَاجَعْتُكِ، قَدْ طَلَّقْتُكِ". وفى لفظٍ رَواه ابنُ بَطَّةَ: "خَلَعْتُكِ، وَرَاجَعْتُكِ، طَلَّقْتُك، رَاجَعْتُكِ". ورَوَى بإسْنادِه عن أبى هُرَيْرةَ، قال: قال رسولُ اللَّهِ -صلى اللَّه عليه وسلم-: "لَا تَرْتَكِبُوا (٣١) مَا ارْتَكَبَتِ الْيَهُوْدُ، فَتَسْتَحِلُّوا (٣٢) مَحَارِمَ اللَّهِ بِأَدْنَى الْحِيَلِ" (٣٣).

فصل: فإن كانتِ الصِّفةُ لا تَعُودُ بعدَ النِّكاحِ الثَّانى، مثل إنْ قال: إنْ أكلتِ هذا الرَّغِيفَ فأنتِ طالق ثلاثًا. ثم أبانَها، فأكلَتْه، ثم نَكَحَها، لم يَحْنَثْ (٣٤)؛ لأنَّ حِنْثَه بوُجودِ الصِّفةِ فى النِّكاحِ الثَّانى، وما وُجِدَتْ، ولا يُمكنُ إيقاعُ الطَّلاقِ بأكْلِها له حالَ البَيْنُونةِ؛ لأنَّ الطَّلاقَ لا يَلحقُ البائنَ. واللَّهُ تعالى أعلمُ.
