Therefore, it must be that it is occurring [at the end]. Were it not for this, three divorces could never occur to a woman who has not been consummated with in any case, because if he said to her: "You are divorced three times," and one divorce occurred upon her before his saying "three," it would be impossible for anything else to fall upon her. As for when he says: "You are divorced, you are divorced," these are two sentences, one of which does not depend on the other. If one of them were followed by a condition, exception, or description, it would not encompass the other, and there is no basis for one of them being held in abeyance for the other. A conjoined element and that which it is conjoined to are a single unit; if a condition followed them, it would return to all of them. Furthermore, the conjoined element does not stand on its own and does not provide meaning in isolation, unlike his saying: "You are divorced," for it is a useful sentence that has no connection to the other, so it is not valid to draw an analogy between them.

غيرُ مُفْتَرِقٍ. فإن قِيلَ: إنما وقفَ (٢٧) أوَّلُ الكلامِ على آخرِه، مع الشَّرْطِ والاسْتِثْناءِ؛ لأنَّه (٢٨) مُغيَّرٌ له، والعَطْفُ لا يُغيِّرُ، فلا يَقِفُ عليه، ونَتَبيَّنُ أنَّه وقع أوَّلَ ما لَفَظَ به، ولذلك لو قال لها (٢٩): أنتِ طالِقٌ، أنتِ طالقٌ. لم يقَعْ إلَّا واحدةٌ. قُلْنا: ما لم يَتمَّ الكلامُ، فهو عُرضَةٌ للتّغييرِ، إمّا بما يَخُصُّه بزمنٍ، أو يُقَيِّدُه بقَيْدٍ كالشَّرْطِ، وإمَّا بما (٣٠) يَمْنَعُ بعضَه كالاسْتِثْناءِ، وإمَّا بما يُبَيِّنُ عددَ الواقعِ، كالصِّفةِ بالعَدَدِ، وأشْباهِ هذا، فيجبُ أن يكونَ واقعًا، ولولا ذلك لَما وقعَ بغيرِ المدْخولِ بها ثلاثٌ بحالٍ؛ لأنَّه لو قال لها: أنتِ طالقٌ ثلاثًا. فوقَعتْ بها طَلقةٌ قبلَ قولِه ثلاثًا، لم يُمْكِنْ أن يقعَ بها شىءٌ آخَرُ. وأمَّا (٣١) إذا قال: أنتِ طالقٌ، أنتِ طالقٌ. فهاتانِ جُمْلتانِ لا تَتعلَّقُ إحْداهما بالأُخْرَى، ولو تَعَقَّبَ إحْداهما شرطٌ أو اسْتِثْناءٌ أو صِفَةٌ، لم يَتَناوَلِ الأُخْرَى، ولا وَجْهَ لوُقوفِ إحْداهما على الأُخْرَى، والمعطوفُ مع المعطوفِ عليه شىءٌ واحدٌ، لو تَعَقَّبَه شرطٌ لعادَ إلى الجميعِ، ولأنَّ المعْطوفَ لا يَستْقِلُّ بنفسِه، ولا يُفيدُ بِمُفْردِه، بخلافِ قولِه: أنتِ طالقٌ. فإنَّها جملةٌ مُفِيدةٌ، لا (٣٢) تَعَلُّقَ لها بالأُخْرَى، فلا يَصحُّ قياسُها عليها.
فصل: فإن قال: أنتِ طالقٌ طَلْقتين ونِصْفًا. فهى عندَنا كالتى قبلَها، يقَعُ الثلاثُ. وقال مُخالِفُونا: يقَعُ طَلْقتانِ. وإن قال: إن دخَلْتِ الدَّارَ فأنتِ طالقٌ. وكرّرَ ذلك ثلاثًا، فدخلَتْ، طَلُقَتْ (٣٣)، فى قولِ الجميعِ؛ لأنَّ الصِّفةَ وُجِدَتْ، فاقْتضَى وُقوعَ الثّلاثِ (٣٤) دَفْعَةً واحدةً. وإن (٣٥) قال: إن دخَلْتِ الدَّارَ فأنتِ طالِقٌ وطالقٌ
