the missing person, until his death or divorce comes to him. (47) This is because it is a doubt regarding the termination of the marital bond, so separation is not established by it, just as if his absence is ostensibly one of safety. As for our evidence, it is what al-Athram and al-Juzajani narrated with their chain of authority from ‘Ubayd ibn ‘Umayr, who said: A man was missing during the time of ‘Umar, and his wife came to ‘Umar and mentioned that to him. He said: "Go and wait for four years." She did so, then came to him. He said: "Go and observe the waiting period of four months and ten days." She did so, then came to him. He said: "Where is the guardian (wali) of this man?" [His guardian came], and he said: "Divorce her." He did so. Then ‘Umar said to her: "Go and marry whom you wish." She married, then her first husband came. ‘Umar said to him: "Where were you?" He said: "O Commander of the Faithful, the devils kidnapped me. By Allah, I do not know in which of Allah's lands I was. I was with a people who enslaved me until a group of Muslims raided them, and I was among what they took as spoils. They said to me: 'You are a human man, and these are from the jinn, so what do you have to do with them?' I told them my story, and they said: 'In which of Allah's lands would you like to wake up?' I said: 'Medina is my land.' So I woke up and I was looking at the Harrah." ‘Umar gave him the choice; if he wished, he could have his wife, or if he wished, he could have the dowry.
