And regarding defiance (nushuz), maintenance lapses due to her departing from his control or her preventing him from the submission that is due from her. This does not cease except by her returning to his control and granting him the submission. This is not achieved during his absence; therefore, if she offered to hand herself over before his consummation of the marriage while he was absent, she would not be entitled to maintenance merely by the offer. It is the same here, and Allah knows best.
(10) In B: "wa-man'iha" (and her preventing).
وفى النُّشوزِ، سقَطَتِ النفقةُ بخُروجِها عن يَدِه، أو مَنْعِها (١٠) له من التَّمْكِينِ المُسْتَحَقِّ عليها، ولا يزولُ ذلك إلَّا بعَوْدِها إلى يَدِه، وتَمْكِينِه منها، ولا يَحْصُلُ ذلك في غَيْبَتِه، ولذلك لو بذَلَتْ تَسْلِيمَ نَفْسِها قبلَ دُخُولِه بها في حال غَيْبَتِه، لم تَسْتَحِقَّ النَّفقةَ بمُجَرَّدِ البَذْلِ، كذا ههُنا، واللَّه أعلمُ.
