It was narrated that Hakim ibn Hizam said that the Messenger of Allah (may Allah bless him and grant him peace) forbade that retribution be sought in the mosque, that poetry be recited in it, or that legal punishments be carried out in it (4). It was narrated from Umar that a man was brought to him, and he said: "Take him out of the mosque, then strike him" (5). It was narrated from Ali that a thief was brought to him, and he said: "O Qanbar, take him out of the mosque, then cut off his hand" (6). This is because mosques were not built for this purpose; they were built for prayer, the recitation of the Quran, and the remembrance of Allah the Almighty. We cannot be certain that an incident might not occur from the one being punished [in the mosque] (7), thereby polluting it or harming it, and Allah the Almighty has commanded its purification, saying: {And We enjoined upon Abraham and Ishmael, [saying], "Purify My House for those who perform Tawaf and those who are staying [there] for worship and those who bow and prostrate [in prayer]"} (8).
1604 - Issue: He said: (The juice, when three days have passed over it, has [1] become forbidden, unless it boils before that, in which case it becomes forbidden.)
As for when the juice boils like the boiling of a pot and throws up its froth, there is no disagreement regarding its prohibition. If three days pass over it and it does not boil, our companions said: It is forbidden. Ahmad said: Drink it for three days, as long as it does not boil; if more than three days pass [2] over it, then do not drink it. Most of the scholars say: It is permissible as long as it does not boil and become intoxicating, due to the statement of the Messenger of Allah (may Allah bless him and grant him peace): "Drink in any vessel, but do not drink that which is intoxicating." رَوَى حَكِيم بنِ حِزامٍ، أنَّ رسولَ اللَّه -صلى اللَّه عليه وسلم- نَهَى أن يُسْتَقَادَ في المسْجدِ، وأن تُنْشَدَ فيه الأشعارُ، وأن تُقامَ فيه الحدودُ (٤). ورُوِىَ عن عمرَ، أنَّه أُتِىَ بِرَجُلٍ، فقال: أخْرِجَاه من المسجدِ، فاضْرِباهُ (٥). وعن عليٍّ، أنَّه أُتِىَ بِسَارِقٍ، فقال: يا قَنْبَرُ، أخْرِجْه من المسجدِ، فاقْطَعْ يدَه (٦). ولأنَّ المساجِدَ لم تُبْنَ لهذا، إنَّما بُنِيَتْ للصَّلَاةِ، وقراءةِ القرآنِ، وذِكْرِ اللَّه تعالى، ولا نَأْمَنُ أن يَحْدُثَ من المحدودِ حَدَثٌ [في المسجدِ] (٧) فيُنَجِّسَه ويُؤْذِيَه، وقد أمرَ اللَّه تعالى بتَطْهيرِه، فقال: {أَنْ طَهِّرَا بَيْتِيَ لِلطَّائِفِينَ وَالْعَاكِفِينَ وَالرُّكَّعِ السُّجُودِ} (٨).
١٦٠٤ - مسألة؛ قال: (وَالْعَصِيرُ إذَا أَتَتْ عَلَيْهِ ثَلَاثَةُ أيَّامٍ، فَقَدْ (١) حَرُمَ، إلَّا أنْ يَغْلِىَ قَبْلَ ذلِكَ، فَيَحْرُمُ)
أمَّا إذا غَلَى العصيرُ كغَلَيَانِ القِدْرِ، وقَذَفَ بزَبَدِه، فلا خلافَ في تَحْريمِه. وإن أتَتْ عليه ثلاثةُ أيَّامٍ ولم يَغْلِ، فقال أصْحابُنا: هو حَرَامٌ. وقال أحمد: اشْرَبْهُ ثلاثًا، ما لم يَغْلِ، فإذا أتى (٢) عليه أكثَرُ من ثلاثةِ أيَّامٍ، فلا تَشْرَبْهُ. وأكثرُ أهِل العلمِ يقولون: هو مُبَاحٌ ما لم يَغْلِ ويُسْكِرْ؛ لقولِ رسول اللَّه -صلى اللَّه عليه وسلم-: "اشْرَبُوا في كُلِّ وِعَاءٍ، وَلَا تَشْرَبُوا مُسْكِرًا". أخْرَجَه (٣) أبو داودَ (٤). ولأنَّ عِلَّةَ تَحْريمِه الشِّدَّةُ المُطْرِبَةُ، وإنَّما ذلك في
