1460 - Issue: Abu al-Qasim, may Allah have mercy on him, said: "And the blood money for a free Muslim is one hundred camels."
The scholars have reached a consensus that camels are the basis for blood money, and that the blood money for a free Muslim is one hundred camels. The transmitted hadiths have indicated this, including the hadith of 'Amr ibn Hazm, the hadith of 'Abd Allah ibn 'Amr regarding the blood money for unintentional homicide, and the hadith of Ibn Mas'ud regarding the blood money for accidental homicide; we will mention them, if Allah wills. The manifest view of al-Khiraqi is that the only basis for blood money is camels. This is one of the two narrations from Ahmad, may Allah have mercy on him, as mentioned by Abu al-Khattab. This is also the opinion of Tawus, al-Shafi'i, and Ibn al-Mundhir.
Al-Qadi said: There is no disagreement within the Madhhab that the bases of blood money are camels, gold, silver (wariq), cattle, and sheep; these are five [types] regarding which there is no disagreement in the Madhhab. This is the opinion of 'Umar, 'Ata', Tawus, and the seven jurists of Medina. Al-Thawri, Ibn Abi Layla, Abu Yusuf, and Muhammad also stated this, because 'Amr ibn Hazm narrated in his letter that the Messenger of Allah (peace and blessings of Allah be upon him) wrote to the people of Yemen: "And indeed, for a believing soul, there is one hundred camels, and upon the people of silver (wariq) is one thousand dinars." Recorded by al-Nasa'i. Ibn 'Abbas narrated that a man from the tribe of 'Adi was killed, so the Prophet (peace and blessings of Allah be upon him) fixed his blood money at twelve thousand [dirhams]. Recorded by Abu Dawud and Ibn Majah. Al-Sha'bi narrated that 'Umar fixed it at one thousand dinars for the people of gold. From 'Amr ibn Shu'ayb, from his father, from his grandfather, that 'Umar stood as a preacher and said: "Indeed, camels have become expensive." He said: So he assessed it at one thousand dinars for the people of gold, and twelve thousand for the people of silver,

١٤٦٠ - مسألة؛ قال أبو القاسم، رَحِمَه اللَّه: (وَدِيَةُ الحُرِّ المُسْلِم مِائَةٌ مِنَ الْإِبِلِ)
أجْمَعَ أهلُ العلمِ على أنَّ الإِبِلَ أصْلٌ في الدِّيَةِ، وأنَّ دِيَةَ الحُرِّ المسلمِ مائةٌ من الإِبِلِ. وقد دَلَّتْ عليه الأحاديثُ الواردةُ؛ منها حديثُ عمرِو بن حَزْمٍ، وحديثُ عبدِ اللَّه بن عَمْرو (١) في دِيَةِ خَطَإِ العَمْدِ، وحديثُ ابنِ مسعودٍ في دِيَةِ الخَطَإِ، وسنذكرُها (٢) إن شاء اللهُ. وظاهرُ كلامِ الْخِرَقِىِّ أنَّ الأصْلَ في الدِّيَةِ الإِبِلُ لا غيرُ. وهذا إحْدَى الرِّوايتَيْنِ عن أحمدَ، رَحِمَه اللهُ، ذكر ذلك أبو الخَطَّابِ. وهو قولُ طَاوُسٍ، والشافعىِّ، وابن المُنْذِرِ. وقال القاضي: لا يخْتلِفُ المذهبُ أَنَّ أُصولَ الدِّيَةِ الإِبلُ والذَّهَبُ والوَرِقُ والبَقَرُ والغَنَمُ، فهذه خَمْسَةٌ لا يخْتلِفُ المذهبُ فيها. وهذا قولُ عمرَ، وعَطاءٍ، وطاوُسٍ، وفُقَهاءِ المدينةِ السَّبْعةِ. وبه قال الثَّوْرِىُّ، وابنُ أبي لَيْلَى، وأبو يوسفَ ومحمدٌ؛ لأنَّ عمرَو بن حَزْمٍ رَوَى في كتابِه، أنَّ رسولَ اللَّه -صلى اللَّه عليه وسلم- كَتَبَ إلى أهلِ اليمنِ: "وأنَّ فِي النَّفْسِ المُؤْمِنَةِ مِائَةً مِنَ الْإِبِلِ، وعَلَى أهْلِ الوَرِقِ (٣) ألْفُ دِينَارٍ". روَاه النَّسَائِىُّ (٤). ورَوَى ابنُ عباسٍ، أنَّ رَجُلًا من بَنِى (٥) عَدِىٍّ قُتِلَ، فجَعَلَ النَّبِىُّ -صلى اللَّه عليه وسلم- دِيَتَه اثْنَى عشرَ ألْفًا. روَاه أبو داودَ، وابنُ ماجَه (٦). ورَوَى الشَّعْبِىُّ، أنَّ عمرَ جَعَلَ على أهلِ الذَّهَبِ ألْفَ دِينارٍ. وعن عمرِو بن شُعَيْبٍ، عن أبِيهِ، عن جَدِّه، أنَّ عمرَ قام خَطِيبًا، فقال: ألا إنَّ الإِبِلَ قد غَلَتْ. قال (٧): فقَوّمَ على أهْلِ الذَّهَبِ ألْفَ دِينارٍ، وعلى أهْلِ الوَرِقِ اثْنَى عشرَ ألْفًا،
