their livestock during the state of fighting them. Our evidence is what was narrated from Abu Bakr al-Siddiq, may Allah be pleased with him, that he said to Yazid ibn Abi Sufyan while advising him when he sent him as a commander for the fighting in the Levant: "And do not burn bees, and do not drown them." It was also narrated from Ibn Mas'ud that his nephew came to him from a military expedition he had undertaken, and he said: "Perhaps you burned a crop?" He said: "Yes." He said: "Perhaps you drowned bees?" He said: "Yes." He said: "Perhaps you killed a child?" He said: "Yes." He said: "Let your raiding be balanced (kifafan)." Sa'id extracted both of these. Something similar is reported from Thawban. It has been confirmed that the Messenger of Allah, peace and blessings of Allah be upon him, forbade killing the bee, and forbade that any of the animals be killed by being tied up and used as a target (sabra). Furthermore, this is an act of corruption, so it falls under the general scope of His saying the Exalted: "And when he goes away, he strives throughout the land to cause corruption therein and destroy crops and cattle. And Allah does not like corruption" [2:205]. Moreover, it is a living being with a soul, so it is not permissible to kill it to enrage the polytheists, just as it is not for their women and children. As for taking the honey and eating it, it is permissible because it is among the permitted food.

بهائِمِهم حالَ قتالِهم. ولَنا، ما رُوِىَ عن أبي بكرٍ الصِّدِّيقِ، رَضِىَ اللهُ عنه، أنَّه قال ليزيدَ ابن أبى سفيان، وهو يُوصِيه، حين بَعَثَه أميرًا على القتال بالشام: ولا تُحَرِّقَنَّ نَحْلًا، ولا تُغَرِّقَنَّهُ. ورُوى عن ابنِ مسعود، أنَّه قَدِمَ عليه ابنُ أخيه من غَزَاةٍ غَزاها، فقال: لَعَلَّك حَرَّقْتَ حَرْثًا؟ قال: نعم. قال: لَعَلَّك غَرَّقْتَ نَحْلًا؟ قال: نعم. قال: لعلَّك قَتَلْتَ صَبِيًّا؟ قال: نعم. قال: لِيَكُنْ غَزْوُك كِفَافًا. أَخْرَجَهُما سعيد (٣). ونحوُ ذلِكَ عن ثَوْبان (٤). وقدْ ثَبَتَ أنَّ رسولَ اللَّه -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- نَهَى عن قَتْلِ النَّحْلَةِ (٥)، ونَهَى أنْ يُقْتَلَ شىءٌ من الدَّوابِّ صَبْرًا (٦). ولأنَّه إفسادٌ، فيدْخُلُ فى عُمومِ (٧) قوله تعالى: {وَإِذَا تَوَلَّى سَعَى فِي الْأَرْضِ لِيُفْسِدَ فِيهَا وَيُهْلِكَ الْحَرْثَ وَالنَّسْلَ وَاللَّهُ لَا يُحِبُّ الْفَسَادَ} (٨). ولأنَّه حيوانٌ ذو رُوحٍ، فلم يجُزْ قتلُه لغَيْظِ المشركين، كنِسَائِهم وصِبْيانِهم. وأمَّا أخذُ العَسَلِ وأَكْلُه فمباحٌ؛ لأنَّه من الطَّعامِ المُباحِ.

١٦٧١ - مسألة؛ قال: (ولَا يَعْقِرُ شَاةً، ولَا دَابَّةً، إلَّا لِأَكْلٍ (١) لَا بُدَّ لَهُمْ مِنْهُ (٢))

أمَّا عَقْرُ دَوابِّهم في غير حالِ الحربِ، لمُغايَظَتِهم، والإِفْسادِ عليهم، فلا يجوزُ، سَواءٌ
