Dawud (45). And from Uthman, may Allah be pleased with him, who said: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say: "A night of guarding in the path of Allah is better than a thousand nights of standing in prayer and days of fasting (46), (47)." Recorded by Ibn Sanjar (48).

1625 - Issue: He said: (If his parents are Muslims, he shall not engage in voluntary Jihad except with their permission.)

Something similar to this was narrated from Umar and Uthman. This is also the view of Malik, al-Awza'i, al-Thawri, al-Shafi'i, and the rest of the scholars. It has been narrated from Abdullah ibn Amr ibn al-As that a man came to the Messenger of Allah (peace and blessings of Allah be upon him) and said: O Messenger of Allah, shall I engage in Jihad? He said: "Do you have two parents?" He said: Yes. He said: "Then struggle for them (i.e., serve them)." (2). A similar report is narrated from Ibn Abbas from the Prophet (peace and blessings of Allah be upon him), recorded by al-Tirmidhi (3), who said: It is a hasan sahih (good and authentic) hadith. In another narration, he said: I came to pledge allegiance to you for Hijra (emigration), and I left my parents weeping. He said: "Return to them and make them laugh as you made them weep." From Abu Sa'id, that a man migrated to the Messenger of Allah (peace and blessings of Allah be upon him), and the Messenger of Allah (peace and blessings of Allah be upon him) said to him:

داوُد (٤٥). وعن عُثمانَ، رَضِىَ اللَّه عنه، قال: سمعتُ رسولَ اللَّه -صلى اللَّه عليه وسلم- يقول: "حَرَسُ لَيْلَةٍ في سَبِيلِ اللهِ، أفْضَلُ مِنْ ألْفِ لَيْلَةٍ، قِيَامِ لَيْلِهَا (٤٦)، وصِيَامِ نَهَارِهَا" (٤٧). رواه ابنُ سَنْجَرَ (٤٨).

١٦٢٥ - مسألة؛ قال: (وَإذَا كَانَ أَبَوَاهُ مُسْلِمَيْن، لَمْ يُجَاهِدْ تَطَوُّعًا إلَّا بإذْنِهِمَا)

رُوِىَ نحوُ ذلك (١) عن عمرَ، وعثمانَ. وبه قال مالِك، والأَوْزاعِيُّ، والثَّوْرِيُّ، والشافِعِيُّ، وسائِرُ أهلِ العِلْم. وقد رَوَى عبدُ اللَّه بن عمرِو بن العاص، قال: جاءَ رجلٌ إلى رسولِ اللَّه -صلى اللَّه عليه وسلم- فقال: يا رسولَ اللهِ، أُجاهِدُ؟ فقال: "أَلكَ أَبوَانِ؟ " قال: نعم. قال: "فَفِيهِمَا فَجَاهِدْ" (٢). وعن ابن عبَّاسٍ، عن النَّبِيِّ -صلى اللَّه عليه وسلم- مثلُه، روَاه التِّرْمِذِىُّ (٣). وقال: حديثٌ حسنٌ صحيحٌ. وفي روايةٍ: فقال: جِئْتُ أُبايِعُكَ على الهِجْرَةِ، وَتَرَكْتُ أبَوَىَّ يَبْكيان. قال: "ارْجِعْ إلَيْهِمَا، فَأَضْحِكْهُمَا كَمَا أَبْكَيْتَهُمَا". وعن أبي سَعيدٍ، أنَّ رجُلًا هاجَرَ إلى رسولِ اللَّه -صلى اللَّه عليه وسلم-، فقال له رسولُ اللَّه -صلى اللَّه عليه وسلم-.
