the Exalted: "It is only that which has been slaughtered for other than Allah that He has forbidden to you" (2). Our evidence is what Abu Tha'labah al-Khushani narrated, saying: The Prophet (may Allah bless him and grant him peace) forbade the eating of every beast of prey possessing fangs. Agreed upon (3). Abu Hurayrah also said that the Messenger of Allah (may Allah bless him and grant him peace) said: "Eating every beast of prey with fangs is forbidden" (4). Ibn 'Abd al-Barr said: This is an established, authentic hadith, the authenticity of which is agreed upon. This is an explicit text that specifies the general nature of the verses. Thus, this includes the lion, the tiger, the leopard, the wolf, the dog, and the swine. It is narrated from al-Sha'bi that he was asked about a man who treats himself with dog meat, and he said: "May Allah not heal him." This indicates that he held the view of its prohibition.

Section: Eating monkeys is not permissible. Ibn 'Umar, 'Ata', Mujahid, Makhul, and al-Hasan disliked it, and they did not permit its sale. Ibn 'Abd al-Barr said: "I do not know of any disagreement among the scholars of the Muslims that the monkey is not to be eaten, and its sale is not permissible." It was narrated from al-Sha'bi that the Prophet (may Allah bless him and grant him peace) forbade monkey meat (6). Furthermore, it is a beast of prey, so it enters under the general meaning of the report, and it is also a transformed species (maskh), so it is among the forbidden foul things (khaba'ith).

Section: The jackal, the mongoose, and the weasel are forbidden. Ahmad was asked about the jackal and the weasel, and he said: "Everything that bites with its fangs is of the beasts of prey." Abu Hanifah and his companions held the same view.

سبحانَه: {إِنَّمَا حَرَّمَ عَلَيْكُمُ الْمَيْتَةَ وَالدَّمَ وَلَحْمَ الْخِنْزِيرِ وَمَا أُهِلَّ بِهِ لِغَيْرِ اللَّهِ} (٢). ولَنا، ما رَوَى أبو ثَعْلَبَةَ الْخُشَنِىُّ، قال: نَهَى النَّبِىُّ -صلى اللَّه عليه وسلم- عن أكلِ كُلِّ ذِى نابٍ من السِّباعِ. مُتَّفَقٌ عليه (٣). وقال أبو هُرَيْرَة: إنَّ رسولَ اللَّه -صلى اللَّه عليه وسلم- قال: "أَكْلُ كُلِّ ذِى نابٍ من السِّباعِ حَرامٌ" (٤). قال ابنُ عبدِ البَرِّ: هذا حَدِيثٌ ثابِتٌ صَحِيحٌ مُجْمَعٌ على صِحَّتِه. وهذا نصٌّ صريحٌ يخُصُّ عمومَ الآياتِ، فيدخلُ فى هذا الأسَدُ، والنَّمِرُ، والفَهْدُ، والذِّئبُ، والكلبُ، والخِنْزيرُ. وقد رُوِىَ عن الشَّعْبِىِّ، أنَّه سُئِلَ عن رجلٍ يتَدَاوَى بلَحْمِ الكلبِ؟ فقال: لا شَفاهُ اللَّه. وهذ! يدلُّ على أنَّه رَأَى تحرِيمَه.

فصل: ولا يُباحُ أَكْلُ القِرْدِ. وكَرِهَهُ ابنُ (٥) عمرَ، وعَطاءٌ، ومُجاهِدٌ، ومكحولٌ، والحسنُ، ولم يُجِيزُوا بَيْعَه. قال ابنُ عبدِ البَرِّ: لا أعْلَمُ بين عُلَماءِ المسلمين خِلافًا أَنَّ القِرْدَ لا يُؤْكَلُ، ولا يجوزُ بَيْعُه. وَرُوِىَ عن الشَّعْبِىِّ، أَنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- نَهَى عن لحمِ القِرْدِ (٦). ولأنَّه سَبُعٌ، فيدْخُلُ فى عُمومِ الخبرِ، وهو مَسْخٌ أيضًا، فيكونُ من الْخَبائِثِ المُحرَّمَةِ.

فصل: وابنُ آوَى، والنِّمْسُ، وابنُ عِرْسٍ، حَرامٌ. سُئِلَ أحمدُ عن ابنِ آوَى وابنِ عِرْسٍ فقال: كُلُّ شىءٍ يَنْهَشُ بأنْيابِه فهو (٥) من السِّباعِ. وبهذا قال أبو حنيفةَ وأصحابُه.
