therein, such as the lamb. It is narrated from 'Ata' and al-Awza'i that the jadh' is valid from all species, due to what Mujashi' from Sulaym narrated, who said: I heard the Prophet (peace be upon him) saying: "The jadh' fulfills what the thani fulfills." Narrated by Abu Dawud, al-Nasa'i, and Ibn Majah (4). Furthermore, it is valid from some species, so it is valid from all of them, like the thani (3). Our argument for the validity of the jadh' from sheep is the hadith of Mujashi' and Abu Hurayrah and others, and for the fact that a jadh' from other than it is not valid, is the saying of the Prophet (peace be upon him): "Do not slaughter anything but a musinnah (mature animal), unless it is difficult for you, then slaughter a jadh' of sheep" (4). Abu Burdah ibn Niyar said: "I have a jadh'ah (lamb) [of goats] (5) that is more beloved to me than two sheep; does it suffice for me?" He replied: "Yes, but it shall not suffice for anyone after you" (6). This is agreed upon. Their hadith is interpreted as referring to the jadh' from sheep for the reason we mentioned. Ibrahim al-Harbi said: "The jadh' from sheep is only valid because it mounts and conceives, whereas if it were a goat, it would not conceive until it becomes a thani."
Section: It is not valid in the sacrifice except for cattle, and even if one of its parents is wild, it is not valid either. It was narrated from al-Hasan ibn Salih that a wild cow is valid [to be sacrificed] on behalf of seven, and a gazelle on behalf of one. The People of Opinion (Ashab al-Ra'y) said: The offspring of a domestic cow is valid, even if its father was wild. Abu Thawr said: It is valid if it is attributed to cattle (bahimat al-an'am). Our argument is the saying of Allah Almighty: {That they may mention the name of Allah over what He has provided for them of the grazing livestock} (7). These are camels, cows, and sheep. Regarding the argument of the People of Opinion, it is a creature produced from both that which is valid and that which is not valid, therefore it is not valid, just as if the mother were wild.
1752 - Issue: He said: (The jadh' of sheep is that which is six months old and has entered the seventh).
Abu al-Qasim said: I heard my father saying: I asked some of the Bedouin: "How do you know that a sheep has reached the jadh' stage?"

منه كالْحَمَلِ، وعن عَطاءٍ، والأوْزاعِىِّ، يُجْزِئُ (١) الجَذَعُ من جميعِ الأجْناس؛ لما رَوَى مُجاشِعٌ، مِنْ (٢) سُلَيْم، قال: سَمِعْتُ النَّبِىَّ -صلى اللَّه عليه وسلم-، يقول: "إِنَّ الْجَذَعَ يُوفِى مِمَّا يُوفِى مِنْهُ الثَّنِىُّ". روَاه أبو داودَ، والنَّسائِىُّ، [وابنُ ماجه (٤). ولأنه يُجْزئ من بعض الأجْناسِ، فأجْزَأ مِن جميعِها، كالثَّنِىِّ] (٣). ولَنا، على أَنَّ الجَذَعَ من الضَّأْنِ يُجْزِئُ، حديثُ مُجاشِع وأبى هُريرَةَ وغيرِهما، وعلى أَنَّ الجَذَعَةَ من غيرِها لا تُجْزِئُ، قولُ النَّبِىِّ -صلى اللَّه عليه وسلم-: "لَا تَذبَحُوا إلَّا مُسِنَّةً، فَإِنْ عَسُرَ عَلَيْكُمْ، فَاذْبَحُوا الْجَذَعَ مِنَ الضَّأْنِ" (٤). وقال أبو بُرْدَةَ بنُ نِيَار: عِنْدِى جَذَعَةٌ [مِن المَعْزِ] (٥)، أحَبُّ إلىَّ من شاتَيْنِ، فهل تُجْزِئ عَنِّى؟ قال: "نَعَمْ، ولَا تُجْزِئُ عَنْ أحَدٍ بَعْدَكَ" (٦). مُتَّفَقٌ عليه. وحَديثُهم محمولٌ على الجَذَعِ من الضَّأْنِ؛ لما ذَكَرْنا. قال إبراهيمُ الْحَرْبِىُّ: إنَّما يُجْزِئ الجَذَعُ من الضَّأْنِ؛ لأنَّه يَنْزُو فَيلْقَحُ، فإذا كان من المَعْزِ لم يَلْقَحْ حتى يكون ثَنِيًّا.
فصل: ولا يُجْزِئُ فى الأُضْحِيَةِ غيرُ بَهِيمَةِ الأنْعامِ، وإِنْ كان أحدُ أَبَوَيْه وحْشِيًّا، لم يُجْزِئُ أيضًا. وحُكِىَ عن الحسنِ بن صالحٍ، أَنَّ بقرَةَ الوَحْشِ تُجْزِئُ عن سبعةٍ، والظَّبْىَ عن واحدٍ. وقال أصْحابُ الرَّأْى: وَلَدُ البَقَرِ الإِنْسِيَّة يُجْزِئُ، وإِنْ كان أبوه وحْشِيًّا. وقال أبو ثَوْرٍ: يُجْزِئُ إذا كان مَنْسُوبًا إلى بَهِيمَةِ الأنْعامِ. ولَنا، قولُ اللَّه تعالى: {لِيَذْكُرُوا اسْمَ اللَّهِ عَلَى مَا رَزَقَهُمْ مِنْ بَهِيمَةِ الْأَنْعَامِ} (٧). وهى الإِبلُ والبَقَرُ والغَنَمُ. وعلى أصْحابِ الرأى، أنَّه مُتَوَلِّدٌ من بَيْنِ ما يُجْزِئُ وما لا يُجْزِئُ، فلم يُجْزِئُ، كما لو كانتْ الأُمُّ وَحْشِيَّةً.
١٧٥٢ - مسألة؛ قال: (وَالْجَذَعُ مِنَ الضَّأْنِ مَا لَهُ سِتَّةُ أَشْهُر، ودَخَلَ فِى السَّابِعِ)
