"And Hind is nothing but an Arabian filly, the offspring of horses that a mule has mounted.\nIf she gives birth to a noble foal, it is but fitting; and if there is corruption (iqraf), the sire has not produced a noble one."\n\nBy 'hajin' here, al-Khiraqi intended everything other than the Arabian horse, and Allah knows best. It has been narrated from Ahmad that he said: "The hajin is the pack horse (birdhawn)." There is a difference in the report from him regarding its shares. Al-Khallal said: The reports from Abu Abd Allah are widespread that for the pack horse, it is one share. This was chosen by Abu Bakr and al-Khiraqi, and it is the opinion of al-Hasan. Al-Khallal said: Three discerning individuals narrated from him that the pack horse is given a share like the share of the Arabian horse. Al-Khallal chose this, and it is the view of Umar ibn Abd al-Aziz, Malik, al-Shafi'i, and al-Thawri, because Allah the Exalted said: {And the horses, mules, and donkeys} (Quran 16:8). These are from the category of 'horses' (al-khayl). Furthermore, the narrators reported that the Prophet (peace be upon him) allocated two shares for the horse and one share for its owner, and this is general for every horse. Also, it is an animal that has a share, so the Arabian and the non-Arabian are equal in it, just like human beings. Abu Bakr narrated from Ahmad (may Allah have mercy on him) a third report, that if the pack horses perform the same as the Arabian horses, they are given a share like the Arabian horse, otherwise they are not. This is the view of Ibn Abi Shaybah, Ibn Abi Khaythamah, Abu Ayyub, and al-Jawzajani, because they are from the category of horses, and they have performed the work of Arabian horses, so they are given their share like the Arabian horse. The Judge narrated a fourth report, that it has no share. This is the view of Malik ibn Abd Allah al-Khath'ami, because it is an animal that does not perform the work of Arabian horses, so it resembles mules. It is possible that this report applies to those among them that do not resemble the noble breeds, based on what al-Jawzajani narrated with his chain of transmission from Abu Musa, that he wrote to Umar ibn al-Khattab: We have found in Iraq horses that are...

وما هِنْدُ إلَّا مُهْرَةٌ عَرَبِيَّةٌ ... سَلِيلَةُ أفْراسٍ تَجَلَّلَها بَغْلُ
فإنْ ولَدَتْ مُهْرًا كَرِيمًا فبالْحَرَى ... وإنْ يكُ إقْرافٌ فما أنْجَبَ الفَحْلُ
وأرادَ الخِرَقِىُّ بالهَجِينِ هاهُنا، ما عدا العَربىَّ، واللَّه أعلم. وقد حُكِىَ عن أحمدَ، أنَّه قال: الْهَجِينُ البِرْذَوْنُ. واختلَفَتِ الرِّوايَةُ عنه فى سُهْمانِها (٣)، فقال الخَلَّالُ: تواتَرَت الرِّواياتُ عن أبى عبد اللَّه فى سِهامِ البِرْذَوْنِ، أنَّه سَهْمٌ واحدٌ. واخْتارَه أبو بكرٍ، والْخِرَقِىُّ، وهو قولُ الحَسَن. قال الخَلَّالُ: وروَى عنه ثلاثةٌ مُتيقِّظون أنَّه يُسْهَمُ للبِرْذَوْنِ مثلُ سهمِ العَرَبِىِّ. واختارَهُ الخَلَّالُ، وبه قال عمرُ بن عبد العزيز، ومالِك، والشافِعِىُّ، والثَّوْرِىُّ؛ لأنَّ اللَّه تعالى قال: {وَالْخَيْلَ وَالْبِغَالَ} (٤). وهذه من الخَيْلِ، ولأنَّ الرُّواةَ رَوَوْا أنَّ النَّبِىَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- أسْهَمَ للفرَسِ سَهْمَيْن، ولصاحِبِه سَهْمًا. وهذا عامٌّ فى كلِّ فَرَسٍ، ولأنَّه حيوانٌ ذو سَهْمٍ، فاسْتَوَى فيه العَرَبىُّ وغيرُه، كالآدَمِىّ. وحكَى أبو بكرٍ، عن أحمدَ، رحِمَه اللَّه، روايةً ثالثة، أنَّ الْبَراذِينَ إنْ أَدْرَكَتْ إدْراكَ العِرَابِ (٥)، أُسْهِمَ لها مِثلُ الفَرَسِ العرَبِىِّ، وإلَّا فلا. وهذا قولُ ابنِ أبى شَيْبَة، وابنِ أبى خَيْثَمَةَ، وأبى أيُّوبَ، والجُوزَجَانِىِّ؛ لأنَّها من الخَيْلِ، وقد عَمِلَت عَمَلَ العِرَابِ، فأُعْطِيَتْ سَهْمَها (٦) كالعَرَبِىِّ. وحكَى القاضى روايةً رابعةً، [أنَّها لا سَهْمَ] (٧) لها. وهو قولُ مالِكِ بنِ عبد اللَّه الخَثْعَمِىِّ (٨)؛ لأنَّه حيوانٌ لا يَعْمَلُ عملَ الخَيْلِ العِرَابِ، فأشْبَهَ الْبِغالَ. ويَحْتَمِلُ أنْ تكونَ هذه الرِّوايةُ فيما لا يُقارِبُ العِتاقَ منها؛ لما روَى الجُوزَجَانِىُّ، بإسْنادِه عن أبى موسى، أنَّه كتَبَ إلى عمرَ بن الخطَّاب: إنَّا (٩) وجَدْنا بالعِراقِ خَيْلًا عِرَاضًا
