Book of the Emancipation of Umm al-Walad (Mothers of Children)

The umm al-walad: She is the one who has given birth from her master while in his possession. There is no disagreement regarding the permissibility of concubinage and having sexual relations with slave women, according to the saying of Allah the Almighty: {And those who guard their private parts, except from their spouses or those their right hands possess, for then they are not to be blamed} (1). Maria the Copt was an umm al-walad to the Prophet (2), peace and blessings of Allah be upon him, and she is the mother of Ibrahim, the son of the Prophet, peace and blessings of Allah be upon him, regarding whom he said (3): "Her offspring has emancipated her" (4). Hajar, the mother of Ismail, peace be upon him, was a concubine to Ibrahim (5), the Khalil (Intimate Friend) of the Most Merciful, peace be upon him. Umar ibn al-Khattab, may Allah be pleased with him, had ummahat awlad for each of whom he bequeathed (6) four hundred [dirhams] (7). Ali, may Allah be pleased with him, had ummahat awlad (8), as did many of the Companions. Ali ibn al-Husayn, al-Qasim ibn Muhammad, and Salim ibn Abd Allah were from ummahat awlad. It is narrated (9) that people were not inclined toward ummahat awlad until these three were born from ummahat awlad, after which people became inclined toward them. It was narrated from Salim ibn Abd Allah that he said: Ibn Rawahah had a slave girl, and he wanted to be alone with her, and his wife was watching him. When the house became empty, he had intercourse with her, and his wife became aware (10) of it,

كتاب عِتْقِ أُمَّهاتِ الأوْلادِ

أمُّ الوَلَدِ: هى التى وَلَدَت مِن سَيِّدِها فى مِلْكِه. ولا خِلافَ فى إباحةِ التَّسَرِّى ووَطْءِ الإِماءِ؛ لقولِ اللَّه تعالى: {وَالَّذِينَ هُمْ لِفُرُوجِهِمْ حَافِظُونَ (٥) إِلَّا عَلَى أَزْوَاجِهِمْ أَوْ مَا مَلَكَتْ أَيْمَانُهُمْ فَإِنَّهُمْ غَيْرُ مَلُومِينَ} (١). وقد كانت مارِيَةُ القِبْطِيَّةُ أُمَّ وَلَدٍ لِلنَّبِىِّ (٢) -صلى اللَّه عليه وسلم-، وهى أمُّ إبراهيمَ بنِ النَّبِىِّ -صلى اللَّه عليه وسلم-، التى قال (٣): "أَعْتَقَها وَلَدُها" (٤). وكانتْ هاجَرُ أُمُّ إسماعيلَ عليه السلام، سُرِّيَّةً لإِبراهيمَ (٥) خَلِيلِ الرحمنِ عليه السَّلام. وكان لعمرَ ابنِ الخَطَّابِ، رَضِىَ اللَّهُ عنه، أُمَّهاتُ أوْلادٍ وَصَّى (٦) لكُلِّ واحِدَةٍ منهنَّ بأرْبَعِمائةٍ أربَعِمائةٍ (٧). وكان لعَلِىٍّ، رَضِىَ اللَّهُ عنه، أُمَّهاتُ أوْلادٍ (٨). ولكثيرٍ من الصحابَةِ. وكان علىُّ ابنُ الحسين، والقاسِمُ بنُ محمد، وسالِمُ بن عبد اللَّه، من أُمَّهاتِ أوْلادٍ. ويُرْوَى (٩) أنّ النَّاسَ لم يكونُوا يَرْغَبُون فى أُمَّهاتِ الأوْلادِ، حتى وُلدَ هؤلاء الثَّلاثةُ من أمَّهاتِ الأوْلادِ، فرَغِبَ الناسُ فِيهِنَّ. ورُوِىَ عن سالِم بنِ عبد اللَّه، قال: كان لابْنِ رَواحَةَ جارِيَةٌ، وكان يُرِيدُ الخَلْوَةَ بها، وكانت امْرَأَتُه تَرْصُدُه، فخَلَا البيتُ، فوَقَعَ عليها، فنَذِرَتْ به (١٠) امْرَأَتُه،
