Al-Mughni by Ibn Qudama - Edited by Al-Turki
Volume 2 · Page 363208 - Issue; He said: (And he shall not prostrate at times when it is not permissible to perform voluntary prayer)

Translation · EN

The taslim (2). And because it is a prayer that has an ihram (opening state), it requires a salutation, like other prayers. The second narration is that there is no taslim in it. This is the view of al-Nakha'i, al-Hasan, Sa'id ibn Jubayr, and Yahya ibn Waththab. It was also narrated from Abu Hanifah. There is a difference of opinion regarding it in the view of al-Shafi'i. Ahmad said: As for the taslim, I do not know what it is. And because it was not reported from the Prophet - peace and blessings of Allah be upon him - that there is a salutation in it, because it has no tashahhud, so a salutation was not legislated for it, unlike the prayer. One taslim is sufficient for him. This is the view of Ishaq, who said: And he says, "Peace be upon you." Al-Qadi said: One taslim is sufficient for him according to one narration. He mentioned in "al-Mujarrad" from Abu Bakr that there is a second narration that it is not sufficient except with two [taslims]. The correct view is the first, because it is a prayer that has no tashahhud in it, so what is legislated for it is one taslim, like the funeral prayer, and it does not require a tashahhud. Ahmad explicitly stated this; because it was not reported from the Prophet - peace and blessings of Allah be upon him - nor from any of his companions.

208 - Issue: He said: (And he does not prostrate during the times in which it is not permissible to perform optional prayer).

Al-Athram said: I heard Abu Abd Allah being asked about someone who recites the prostration of the Qur'an after the Fajr (dawn) prayer and after the Asr (afternoon) prayer; should he prostrate? He said: No. This is also the view of Abu Thawr. It was narrated from Ibn Umar, Sa'id ibn al-Musayyab, and Ishaq. Malik disliked the recitation of the verse of prostration during (1) the forbidden time. And there is another narration from Ahmad that he should prostrate. [This is the view of] (2) al-Shafi'i. This was also narrated from

Notes

= And it is narrated that from Abu Hanifah. Al-Shafi'i's opinion regarding it varies. The basis for the narration chosen by al-Khiraqi is the saying of the Prophet - peace and blessings of Allah be upon him -: "Its prohibition is the takbir, and its release is the taslim." And because it is a prayer that has an ihram, it requires a salutation, like other prayers, and it does not require a tashahhud. Ahmad explicitly stated this in a narration by al-Athram; because it was not reported, and because there is no bowing in it, so it has no tashahhud, like the funeral prayer. One taslim is sufficient for him. Ahmad explicitly stated this in a narration by Harb and Abd Allah. He said: He performs one taslim. Al-Qadi said: It is sufficient for him according to one narration. Ishaq said: He performs a taslim only to his right: Peace be upon you. And he said in "al-Mujarrad", from Abu Bakr: That there is another narration, that it is not sufficient for him except with two." (2) Preceded on page 127. (1) Omitted from: (M). (2) In (M): "And this is the view of".
