Section: Our companions added the slaughterhouse, the garbage dump, the main thoroughfare, and the roof of the Kaaba, because they appear in the report of Umar and his son (16). They said: Prayer is not permitted in them. Al-Khiraqi did not mention them. It is possible that he permitted prayer in them, which is the opinion of the majority of scholars, due to the generality of his saying, peace and blessings be upon him: "The earth has been made a place of prayer for me," which is authentic and unanimously agreed upon (17). He excepted from it the graveyard, the bathhouse, and camel resting places, by means of specific authentic hadiths. Thus, in what is other than those, the ruling remains based on the generality [of the text]. The hadith of Umar and his son is narrated by al-Umari (18) and Zayd ibn Jubayrah (19); their memories have been criticized, so the authentic hadith is not to be abandoned for their hadith. This is the more correct [view], and most of our companions, as far as I know, have acted upon the report of Umar and his son regarding the prohibition of prayer in the seven locations. The meaning of 'main thoroughfare' [mahajjat al-tariq] is the traveled path that pedestrians use. 'The high road' [qari'at al-tariq] refers to that which is struck by feet—a derivative form in the sense of the passive [i.e., that which is trodden], such as markets, watering places, and the main road for travel. There is no harm in praying [in what lies to the right and left of it where the treading of feet is not frequent. Likewise, there is no harm in praying] (21) on roads that have few travelers, such as the paths to small dwellings. The slaughterhouse is the place where butchers and their like slaughter animals, known (22) for that and designated for it. The garbage dump is the place where refuse is gathered. There is no difference in these locations between what is pure or impure, nor whether the road is frequented or not; nor in the resting places, between whether there are camels there at that (23) time or not. فصل: وزَادَ أصْحَابُنا المَجْزَرَةَ، والمَزْبَلَةَ، ومَحَجَّةَ الطَّرِيقِ، وظَهْرَ الكَعْبَةِ؛ لأنَّها في خَبَرِ عمرَ وابْنِه (١٦). وقالُوا: لا يجُوزُ فيها الصَّلاةُ. ولم يَذْكُرْهَا الخِرَقِىُّ. فيَحْتَمِلُ أنَّه جَوَّزَ الصَّلاةَ فيها، وهو قولُ أكثر أهلِ العِلْمِ؛ لِعُمُومِ قولِه عليه الصَّلاةُ والسَّلامُ: "جُعِلَتْ لِىَ الأَرضُ مَسْجدًا" وهو صَحِيحٌ مُتَّفَقٌ عليه (١٧). واسْتَثْنَى منه المَقْبَرَةَ، والحَمَّامَ، ومَعَاطِنَ الإِبِلِ، بأحادِيثَ صَحِيحَةٍ خاصَّة، ففيما عَدَا ذلك يَبْقَى على العُمُومِ. وحَدِيثُ عمرَ وابْنِه يَرْوِيهما العُمَرِىُّ (١٨)، وزَيْدُ بنُ جَبِيرَةَ (١٩)؛ وقد تُكُلِّمَ فيهما من قِبَلِ حِفْظِهِما، فلا يُتْرَكُ الحَدِيثُ الصَّحِيحُ بِحدِيثهِما. وهذا أصَحُّ، وأكْثَرُ أصْحَابِنا، فيما عَلِمْتُ، عَمِلُوا بِخَبَرِ عمرَ وابْنِه في المَنْعِ من الصَّلاةِ في المَوَاضِع السَّبْعَة. ومَعْنَى مَحَجَّةِ الطَّرِيقِ: الجَادَّةُ المَسْلُوكَةُ التي تَسْلُكُها السَّابِلَةُ. وقَارِعَة الطَّرِيقِ: يعني التي تَقْرَعُها الأقْدَامُ، فاعِلَةٌ بمعنى مَفْعُولَةٍ، مثل الأسْواقِ والمَشَارِعِ والجادَّةِ لِلسَّفَرِ. ولا بَأْسَ بالصَّلاةِ [فيما علَا منها يَمْنَةً ويَسْرَةً ولم يَكْثُرْ قَرْعُ الأقْدَامِ له (٢٠). وكذلك لا بَأْسَ بالصَّلاةِ] (٢١) في الطُّرُق التي يَقِلُّ سَالِكُوها، كطُرُقِ الأبياتِ اليَسِيرَة. والمَجْزَرَةُ: المَوْضِعُ الذي يَذْبَحُ القَصَّابون وشِبْهُهُم فيه البَهَائِمَ مَعْرُوفًا (٢٢) بذلك مُعَدًّا. والمَزْبَلَةُ: المَوْضِعُ الذي يُجْمَعُ فيه الزِّبْلُ. ولا فَرْقَ في هذه المَوَاضِع بَيْنَ ما كان منها طَاهِرًا أو نَجِسًا، ولا بين كَوْن الطَّرِيقِ فيها سَالِكًا أو لم يكنْ؛ ولا في المَعَاطِنِ بين أن يكونَ فيها إبلٌ في ذلك (٢٣) الوَقْتِ أو لم يكنْ. وأمَّا
