232 - Issue: Abu al-Qasim said: "And one shall make up missed obligatory prayers."
The general rule is that it is permissible to make up missed obligatory prayers at all times of prohibition and otherwise. This has been narrated from Ali, may Allah be pleased with him, and more than one of the Companions. This was also stated by Abu al-Aliyah, al-Nakha'i, al-Sha'bi, al-Hakam, Hammad, Malik, al-Awza'i, al-Shafi'i, Ishaq, Abu Thawr, and Ibn al-Mundhir. The scholars of opinion (Ashab al-Ra'y) said: Missed prayers are not to be made up during the three times mentioned in the hadith of Uqbah ibn Amir, except for the Asr of that same day, which one performs before sunset, due to the generality of the prohibition, which covers obligatory prayers and others, and because when the Prophet, may Allah bless him and grant him peace, slept through the Fajr prayer until the sun rose, he delayed it until the sun had whitened. This is agreed upon (1). Furthermore, it is a prayer, so it is not permissible at these times, like voluntary prayers. It has been narrated from Abu Bakr, may Allah be pleased with him, that he slept in a daliyah (a place for irrigation), and woke up at sunset, so he waited until the sun set and then prayed.

٢٣٢ - مسألة؛ قال أبو القاسِمِ: (ويَقْضِى الفَوَائِتَ من الصَّلَوَاتِ الفَرْضِ)
وجُمْلَتُه أنَّه يَجُوزُ قَضَاءُ الفَرائِضِ الفَائِتَةِ في جَمِيعِ أوْقاتِ النَّهْىِ وغيرِها. رُوِىَ نحوُ ذلك عن عليٍّ، رَضِىَ اللهُ عنه، وغيرِ واحِدٍ من الصَّحابةِ. وبه قال أبو العَالِية، والنَّخَعِىُّ، والشَّعْبِىُّ، والحَكَمُ، وحَمَّادٌ، ومالِكٌ، والأَوْزَاعِىُّ، والشَّافِعِىُّ، وإسْحاقُ، وأبو ثَوْرٍ، وابنُ المُنْذِرِ، وقال أصْحابُ الرَّأْىِ: لا تُقْضَى الفَوَائِتُ في الأوْقاتِ الثَّلَاثَة التي في حَدِيثِ عُقْبَةَ بن عامِرٍ، إلا عَصْرَ يَوْمِه يُصَلِّيها قبلَ غُرُوبِ الشَّمْس؛ لِعُمُومِ النَّهْىِ، وهو مُتَنَاوِلٌ لِلْفَرَائِضِ وغيرِها، ولأنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- لمَّا نَامَ عن صَلَاةِ الفَجْرِ حتى طَلَعَتِ الشَّمْسُ، أخَّرَهَا حتى ابْيَضَّتِ الشَّمْسُ. مُتَّفَقٌ عليه (١). ولأنَّها صَلاةٌ، فلم تَجُزْ في هذه الأوْقات كالنَّوَافِلِ، وقد رُوِىَ عن أبي بكر، رَضِىَ اللَّه عنه، أنَّه نامَ في دَالِيةٍ، فاسْتَيْقَظَ عندَ غُرُوبِ
