of the two groups does not complete its required number with the other group, nor is the Friday prayer obligatory upon them by completing the count with the other group; rather, they are only required to set out for it if there is no Friday prayer, so they are like the people of [a neighborhood near the city] (12).
292 - Issue: He said: "And there is no Friday prayer upon a traveler, nor a slave, nor a woman."
From Abu Abd Allah, may Allah have mercy on him, there are two narrations regarding the slave: one of them is that the Friday prayer is obligatory upon him. The other narration is that it is not obligatory upon him. As for the woman, there is no disagreement that the Friday prayer is not upon her. Ibn al-Mundhir said: All of the scholars from whom we have knowledge are in consensus that there is no Friday prayer upon women. This is because the woman is not among those expected to attend public gatherings of men, and for this reason, the congregational prayer is not obligatory upon her. As for the traveler, the majority of scholars hold the view that the Friday prayer is likewise not upon him. This was stated by Malik regarding the people of Medina, al-Thawri regarding the people of Iraq, al-Shafi'i, Ishaq, and Abu Thawr. This has been narrated from Ata', Umar ibn Abd al-Aziz, al-Hasan, and al-Sha'bi. It was narrated from al-Zuhri and al-Nakha'i that it is obligatory upon him, because the congregational prayer is obligatory upon him, so the Friday prayer is more deserving. Our evidence is that the Prophet (peace be upon him) used to travel and would not perform the Friday prayer during his journey; he was at Arafat during the Farewell Pilgrimage on a Friday, and he performed Dhuhr and Asr, combined them, and did not perform a Friday prayer. The Rightly Guided Caliphs, may Allah be pleased with them, used to travel for Hajj (1) and other purposes, and none of them performed the Friday prayer during their travels, and likewise others among the companions of the Messenger of Allah (peace be upon him) and those who came after them. Ibrahim said: They would reside in al-Rayy for a year or more than that, and in Sijistan for years, neither performing the Friday prayer nor praying in the open field. From al-Hasan, from Abd al-Rahman ibn Samurah, who said: I resided with him for two years (2) in Kabul, he would shorten the prayer and not perform the Friday prayer.

الفَرِيقَيْنِ لا يَتِمُّ عَدَدُها بالفَرِيقِ الآخَرِ، ولا تَلْزَمُهُم الجُمُعَةُ بكَمَالِ العِدَّةِ بالفَرِيقِ الآخَر، وإنَّما يَلْزَمُهم السَّعْىُ إذا لم يكنْ جُمُعَةً، فهم كأهْلِ [المَحَلَّةِ القَرِيبَةِ من المِصْرِ] (١٢).
٢٩٢ - مسألة؛ قال: (ولا جُمُعَةَ عَلَى مُسَافِرٍ، وَلَا عَبْدٍ، وَلَا امْرَأَةٍ)
وعن أبي عبدِ اللهِ، رَحِمَهُ اللهُ، في العَبْدِ رِوَايتانِ: إحْدَاهما، أنَّ الجُمُعَةَ عليه وَاجِبَةٌ. والرِّوَايَةُ الأُخْرَى ليستْ عليه بوَاجِبَةٍ. أمَّا المَرْأَةُ فلا خِلافَ في أنَّها لا جُمُعَةَ عليها. قال ابنُ المُنْذِرِ: أجْمَعَ كُلُّ من نَحْفَظُ عنه من أهْلِ العِلْمِ أنْ لا جُمُعَةَ على النِّساءِ. ولأنَّ المَرْأَةَ ليستْ من أهْلِ الحُضُورِ في مَجامِعِ الرِّجالِ، ولذلك لا تَجِبُ عليها جَماعةٌ. وأمَّا المُسَافِرُ فأَكثرُ أهْلِ العِلْمِ يَرَوْنَ أنَّه لا جُمُعَةَ عليه كذلك. قالَه مالِكٌ في أهْلِ المَدِينَةِ، والثَّوْرِىُّ في أهْلِ العِرَاقِ، والشَّافِعِىُّ، وإسحاقُ، وأبو ثَوْرٍ. وَرُوِىَ ذلك عن عَطَاءٍ، وعمرَ بن عبدِ العزيزِ، والحسنِ، والشَّعْبِىِّ. وحُكِىَ عن الزُّهْرِىِّ، والنَّخَعِىِّ، أنَّها تَجِبُ عليه؛ لأنَّ الجَمَاعَةَ تَجِبُ عليه، فالجُمُعَةُ أوْلَى. ولَنا، أنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- كان يُسَافِرُ فلا يُصَلِّى الجُمُعَةَ في سَفَرِه، وكان في حَجَّةِ الوَدَاعِ بِعَرَفَةَ يومَ جُمُعَةٍ، فصَلَّى الظُّهْرَ والعَصْرَ، وجَمَعَ بينهما، ولم يُصَلِّ جُمُعَةً، والخُلَفَاءُ الرَّاشِدُونَ، رَضِىَ اللهُ عنهم، كانُوا يُسَافِرُونَ للحَجِّ (١) وغيرِه، فلم يُصَلِّ أحَدٌ منهم الجُمُعَةَ في سَفَرِه، وكذلك غيرُهم من أصْحابِ رسولِ اللهِ -صلى اللَّه عليه وسلم- ومَن بَعْدَهم. وقد قال إبراهيمُ: كانوا يُقِيمُونَ بالرّىِّ السَّنَةَ وأكْثَرَ من ذلك، وبِسجِسْتَانَ السِّنِينَ. لا يُجَمِّعُونَ ولا يُشَرِّقُونَ. وعن الحسنِ عن عبدِ الرحمنِ بن سَمُرَةَ قال: أقَمْتُ معه سَنَتَيْن (٢) بكَابُلَ، يَقْصُرُ
