Many. From 'Ubadah ibn al-Samit, that the Prophet (peace and blessings of Allah be upon him) said: "There are five prayers that Allah has prescribed upon the servant during the day and night. Whoever performs them, without neglecting any part of them out of disregard for their status, has a covenant with Allah that He will admit him into Paradise. And whoever does not perform them, has no covenant with Allah; if He wills, He will punish him, and if He wills, He will admit him into Paradise." (24) If he were a disbeliever, He would not have placed him under the scope of [Divine] Will. Al-Khallal said in his "Jami'": Yahya narrated to us, 'Abd al-Wahhab narrated to us, Hisham ibn Hassan narrated to us, from 'Abd Allah ibn 'Abd al-Rahman, from Abu Shumaylah, that the Prophet (peace and blessings of Allah be upon him) went out to Quba' and was met by a group of the Ansar carrying a funeral [bier] on a door. The Prophet (peace and blessings of Allah be upon him) asked: "What is this?" They said: "A slave belonging to such-and-such family, such-and-such was his condition." He said: "Did he bear witness that there is no god but Allah?" They said: "Yes, but he used to do such and such [sins]." He said to them (25): "Did he not pray?" They said: "He would pray sometimes and omit it at others." He said to them: "Go back with him, wash him, shroud him, pray over him, and bury him, for by the One in Whose hand is my soul, the angels almost intervened between me and him." He also narrated with his chain of transmission from 'Ata', from 'Abd Allah ibn 'Umar, who said: The Messenger of Allah (peace and blessings of Allah be upon him) said: "Pray over whoever says there is no god but Allah." (26) This is because this is the consensus of the Muslims; for we do not know of any era in which someone who abandoned prayer was denied washing, funeral prayer, and burial in the Muslim cemeteries, nor were his heirs prevented from inheriting from him, nor was he prevented from inheriting from his deceased, nor were spouses separated due to one of them abandoning prayer; [despite the large number of] (28) those who abandoned prayer. If he were a disbeliever, all of these rulings would have been established, and we know of no disagreement among the Muslims that it is obligatory for the one who abandons prayer to make it up (qada'), whereas if he were an apostate, it would not

كَثِيرٌ. وعن عُبادَةَ بن الصَّامِتِ، أنَّ النَّبِىَّ -صلى اللَّه عليه وسلم-، قال: "خَمْسُ صَلَوَاتٍ كَتَبَهُنَّ اللهُ على العَبْدِ في اليَوْمِ واللَّيْلَةِ، فَمَنْ جَاءَ بِهِنَّ، لَمْ يُضَيِّعْ مِنْهُنَّ شَيْئًا اسْتِخْفَافًا بِحَقِّهِنَّ، كَانَ لَهُ عِنْدَ اللهِ عَهْدٌ أنْ يُدْخِلَهُ الْجَنَّةَ، وَمَنْ لَمْ يَأْتِ بِهِنَّ، فلَيْسَ لَهُ عِنْدَ اللهِ عَهْدٌ، إنْ شَاءَ عَذَّبَهُ، وإنْ شَاءَ أدْخَلَهُ الجَنَّةَ" (٢٤). ولو كان كافِرًا لم يُدْخِلْهُ في المَشِيئَةِ. وقال الخَلَّالُ، في "جَامِعِهِ": ثنا يحيى، ثنا عَبْدُ الوَهَّابِ، ثنا هِشامُ بن حَسَّانَ، عن عبدِ اللهِ بنِ عبدِ الرحمنِ، عن أبي شُمَيْلَةَ، أنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- خَرَجَ إلى قُبَاءَ فاسْتَقْبَلَهُ رَهْطٌ من الأنْصارِ يَحْمِلُونَ جِنَازَةً على بَابٍ، فقال النَّبِىُّ -صلى اللَّه عليه وسلم-: "مَا هَذَا؟ " قالوا: مَمْلُوكٌ لآل فُلَانٍ، كان من أمْرِهِ. قال: "أكَانَ يَشْهَدُ أنْ لَا إلهَ إلَّا اللهُ؟ " قالوا: نعم، ولَكِنَّهُ كان وكان. فقال لهم (٢٥): "أَمَا كَانَ يُصَلِّى؟ " فقالوا: قد كان يُصَلِّى ويَدَعُ. فقال لهم: "ارْجِعُوا بِهِ، فَغَسِّلُوهُ، وكَفِّنُوهُ، وصَلُّوا عَلَيْهِ، وَادْفِنُوهُ، وَالَّذِى نَفْسِى بِيَدِهِ، لَقَدْ كَادَتِ الْمَلَائِكَةُ تَحُولُ بَيْنِى وبَيْنَه". ورَوَى بإسْنَادِه، عن عَطَاءٍ، عن عبدِ اللهِ بن عمرَ، قال: قال رسولُ اللهِ -صلى اللَّه عليه وسلم-: "صَلُّوا عَلَى مَنْ قَالَ لَا إلهَ إلَّا اللهُ" (٢٦). ولأنَّ ذلك إجْمَاعُ المُسْلِمِينَ، فإنَّا لا نَعْلَمُ في عَصْرٍ من الأعْصَارِ أحَدًا من تَارِكِى الصلاةِ تُرِكَ تَغْسِيلُه، والصلاةُ عليه، ودَفْنُهُ في مَقابِر المُسْلِمِينَ، ولا مُنِعَ وَرَثَتُهُ مِيراثَهُ، ولا مُنِعَ هو مِيرَاثَ مُوَرِّثِه، ولا فُرِّقَ بين زَوجَيْنِ لِتَرْكِ الصلاةِ من (٢٧) أحَدِهِما؛ [مع كثْرةِ] (٢٨) تَارِكِى الصلاة، ولو كان كَافِرًا لَثَبَتَتْ هذه الأحْكامُ كُلُّها، ولا نعْلَمُ بين المُسْلِمِينَ خِلَافًا في أنَّ تَارِكَ الصَّلَاةِ يَجِبُ عليه قضَاؤُها، ولو كان مُرْتَدًّا لم
