Translation · EN

is evidence that the prayer of the Prophet (peace and blessings of Allah be upon him) was performed at the head of the grave so that it would be close to the limit; thus, prayer after a month is permissible if it is near that timeframe, due to the indication of the report regarding it. It is not permitted after that, because there is no report for it.

374 - Issue: He said: (And if the heirs dispute over the shroud, it shall be set at thirty dirhams; if he was wealthy, then at fifty).

The gist of this is that it is recommended to improve the shroud of the deceased, based on evidence narrated by Muslim that the Prophet (peace and blessings of Allah be upon him) mentioned a man among his companions who had passed away and was shrouded in a poor-quality shroud. He said: "If one of you shrouds his brother, let him make his shroud good." It is recommended to shroud him in white, due to the saying of the Messenger of Allah (peace and blessings of Allah be upon him): "Wear your white garments, for they are the purest and best, and shroud your dead in them." Narrated by al-Nasa'i. The Messenger of Allah (peace and blessings of Allah be upon him) was shrouded in three Sahuli garments. If the heirs dispute regarding the shroud, his shroud is to be determined according to his condition. If he was wealthy, his shroud should be fine and good, and it should be based on what he used to wear during his lifetime. If he was less than that, then it should be according to his status. The statement of al-Khiraqi: "It is set at thirty dirhams, and if he was wealthy, then at fifty," is not by way of strict limitation, as there is no specific text or consensus regarding it, and limitation can only be established by one of those two. It is merely an estimation; perhaps the good and moderate quality in his time was obtained for the amount he mentioned. It has been narrated from Ibn Mas'ud that he left a will to be shrouded for around thirty dirhams. It is recommended to be shrouded in new material, unless the deceased bequeaths otherwise, in which case his will is to be executed, as was narrated from Abu Bakr al-Siddiq, may Allah be pleased

دليلٌ (٤) على أنَّ صلاةَ النَّبِيِّ -صلى اللَّه عليه وسلم- كانت عندَ رَأْسِهِ، لِيكونَ مُقَارِبًا لِلْحَدِّ، وتجوزُ الصلاةُ بعد الشَّهْرِ قَرِيبًا منه؛ لِدَلَالَةِ الخَبَرِ عليه، ولا يجوزُ بعدَ ذلك؛ لِعَدَمِ وُرُودِهِ.

٣٧٤ - مسألة؛ قال: (وَإذَا تَشَاحَّ الْوَرَثَةُ فِي الْكَفَنِ، جُعِلَ بِثَلَاثِينَ دِرْهَمًا، فَإنْ كَانَ مُوسِرًا فَبِخَمْسِينَ)

وجُمْلَةُ ذلك أنَّه يُسْتَحَبُّ تَحْسِينُ كَفَنِ المَيِّتِ، بِدَلِيلِ ما رَوَى مُسْلِمٌ، أنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- ذكر رَجُلًا من أصْحَابِه قُبِضَ، فَكُفِّنَ في كَفَنٍ غيرِ طَائِلٍ، فقال: "إذَا كَفَّنَ أَحَدُكُمْ أَخَاهُ، فَلْيُحْسِنْ كَفَنَهُ" (١). ويُسْتَحَبُّ تَكْفِينُهُ في البَيَاضِ؛ لِقَوْلِ رسولِ اللَّه -صلى اللَّه عليه وسلم-: "الْبَسُوا مِنْ ثِيَابِكُم البَيَاضَ؛ فَإنَّهُ أَطْهَرُ وأَطْيَبُ، وكَفِّنُوا فِيهَا مَوْتَاكُمْ". رَوَاهُ النَّسَائِىُّ (٢). وكُفِّنَ رسولُ اللهِ -صلى اللَّه عليه وسلم- في ثلاثةِ أثْوابٍ سَحُولِيَّةٍ (٣). وإن تَشَاحَّ الوَرَثَهُ في الكَفَنِ، جُعِلَ كَفَنُه بحسَبِ حَالِه، إنْ كان مُوسِرًا كان كَفَنُه رَفِيعًا حَسَنًا، ويُجْعَلُ على حَسَبِ ما كان يَلْبَسُ في حال الحيَاةِ، وإن كان دُونَ ذَلِكَ فعلَى حَسَبِ حالِه. وقولُ الْخِرَقِىِّ: "جُعِلَ بِثَلَاثِينَ دِرْهَمًا، وإن كان مُوسِرًا فَبِخَمْسِينَ". ليس هو على سَبِيلِ التَّحْدِيدِ، إذ لم يَرِدْ فيه (٤) نَصٌّ، ولا فيه إجْماعٌ، والتَّحْدِيدُ إنَّما يكونُ بأحَدِهما، وإنَّما هو تَقْرِيبٌ، فلعَلَّه كان يَحْصُلُ الجَيِّدُ والمُتَوَسّطُ في وَقْتِه بالقَدْرِ الذي ذَكَرَهُ، وقد رُوِىَ عن ابنِ مسعودٍ، أنَّه أوْصَى أن يُكَفَّنَ بنحوٍ من ثلاثينَ دِرْهَمًا. والمُسْتَحَبُّ أن يُكَفَّنَ في جَدِيدٍ، إلَّا أن يُوصِىَ المَيِّتُ بغيرِ ذلك، فتُمْتَثَلُ وَصيَّتُه، كما رُوِىَ عن أَبى بكرٍ الصِّدِّيقِ، رَضِىَ اللَّه
