and enjoyment, so it is the same regarding washing. Inheritance is not among the requirements, as evidenced by the case of the spouses if one of them is a slave, and the istibra' (clearing of the womb) here is like the 'iddah. Moreover, when she dies, he is obligated to provide her shroud, burial, and expenses, unlike the wife. As for slave women other than the umm al-walad, it is possible that it is not permitted for her to wash her master, because ownership was transferred to someone else, and there was no enjoyment between them such that she would be considered in the meaning of wives. If he died before consummating the marriage with his wife, it is possible that it is not permissible for her to wash him for that reason. And Allah knows best.

Section: If the wife is a dhimmi (non-Muslim citizen), she is not permitted to wash her husband, because a disbeliever does not wash a Muslim, as the intention (niyyah) is obligatory for the washing, and the disbeliever is not among those capable of it. Furthermore, her husband is not permitted to wash her, because a Muslim does not wash a disbeliever, nor does he take charge of their burial, and because there is no inheritance or allegiance between them, and the marital bond is severed by death. It is possible to deduce the permissibility of that based on the permissibility of a Muslim washing a disbeliever.

Section: It is not permitted for men other than those we have mentioned to wash any woman, nor for any of the women to wash men other than those we have mentioned, even if they are unmarriageable relatives (dhu rahim mahram). This is the view of most scholars. It was narrated from Abu Qilabah that he washed his daughter. Ahmad considered this grave and did not approve of it. He said: "Has it not been said: 'Seek permission to enter upon your mother'?" This is because she is a mahram (unmarriageable relative) during life, so it is not permitted to wash her, just like an unrelated woman or his foster sister. If necessity dictates that, by not finding any woman to wash the woman, then Muhanna said: I asked Ahmad about a man washing his sister if he does not find women. He said: "No." I asked: "How should he do it?" He said: "He washes her while she is in her clothes, pouring water over her." I asked Ahmad: "And is every mahram relative washed while in her clothes?" He said: "Yes." Al-Hasan, Muhammad, and Malik said: There is no harm

والاسْتِمْتاعِ، فكذلك في الغَسْلِ، والمِيرَاثُ ليس مِن المُقْتضَى، بِدَلِيلِ الزَّوْجَيْنِ إذا كان أحَدُهما رَقِيقًا، والاسْتِبْراءُ ها هُنا كالعِدَّةِ. ولأنَّها إذا ماتَتْ يَلْزَمُه كَفَنُها ودَفْنُها (٥) ومُؤْنَتُها، بخِلافِ الزَّوْجَةِ. فأمَّا غيرُ أُمِّ الوَلدِ من الإِماءِ، فيَحْتَمِلُ أن لا يجوزَ لها غَسْلُ سَيِّدِها؛ لأنَّ المِلْكَ انْتَقَلَ فيها إلى غيرِه، ولم يكنْ بينهما من الاسْتِمْتَاعِ ما تَصِيرُ به في مَعْنَى الزَّوْجاتِ. ولو ماتَ قبلَ الدُّخُولِ بامْرَأتِه احْتَمَلَ أن لا يُباحَ لها غَسْلُه لذلك. واللهُ أعلمُ.

فصل: وإن كانت الزَّوْجَةُ ذِمِّيِّةً، فليس لها غَسْلُ زَوْجِها، لأنَّ الكافِرَ لا يُغَسِّلُ المُسْلِمَ، لأنَّ النِّيَّةَ وَاجِبَةٌ في الغُسْلِ، والكَافِرُ ليس مِن أهْلِها، وليس لِزَوْجِها غَسْلُها؛ لأنَّ المُسْلِمَ لا يُغَسِّلُ الكافِرَ، ولا يَتَوَلَّى دَفْنَهُ، ولأنَّه لا مِيراثَ بينهما، ولا مُوَالاةَ، وقد انْقَطَعَتِ الزَّوْجِيَّةُ بِالمَوْتِ. ويَتَخَرَّجُ جَوازُ ذلك بِنَاءً على جَوازِ غسْلِ المُسْلِمِ الكافِرَ.

فصل: وليس لِغيرِ مَن ذَكَرْنَا من الرِّجالِ غَسْلُ أحَدٍ من النِّساءِ، ولا أحَدٍ (٦) من النِّساءِ غَسْلُ غيرِ مَن ذَكَرْنَا من الرِّجالِ، وإن كُنَّ ذَواتَ رَحِمٍ مَحْرَمٍ. وهذا قَوْلُ أكْثَرِ أهْلِ العِلْمِ. وحُكِىَ عن أبي قِلَابَةَ أنَّه غَسَّلَ ابْنَتَهُ. واسْتَعْظَمَ أحمدُ هذا، ولم يُعْجبْهُ. وقال: أليس قد قِيلَ: اسْتَأْذِنْ على أُمِّكَ. وذلك لأنَّها مُحَرَّمَةٌ حالَ الحياةِ، فلم يَجُزْ غُسْلُها كالأجْنَبِيَّةِ، وأخْتِه من الرَّضاعِ. فإن دَعَتِ الضَّرُورَةُ إلى ذلك، بأنْ لا يُوجَدَ من يُغَسِّلُ المَرْأَةَ من النِّساءِ، فقال مُهَنَّا: سألتُ أحمدَ عن الرَّجُلِ يُغَسِّلُ أُخْتَه إذا لم يَجِدْ نِسَاءً. قال: لا. قلتُ: فكيف يَصْنَعُ؟ قال: يُغَسِّلُها وعليها ثِيَابُها، يَصُبُّ عليها الماءَ صَبًّا. قلتُ لأحمدَ: وكذلك كلُّ ذَاتِ مَحْرَمٍ تُغَسَّلُ وعليها ثِيابُها؟ قال: نعم. وقال الحسنُ، ومحمدٌ، ومالِكٌ: لا بَأْسَ
