Prophet (peace and blessings of Allah be upon him) asked: "What is the matter with Hanzalah? For I have seen the angels washing him." They said: "He had sexual intercourse, then heard the commotion, so he went out to fight." Narrated by Ibn Ishaq in al-Maghazi. This is because it is a mandatory washing for a reason other than death, so it is not dropped by death, like the washing for major ritual impurity (janaba). Their hadith has no generality, for it is a case regarding a specific incident that occurred concerning the martyrs of Uhud, whereas our hadith is specific to Hanzalah, and he is one of the martyrs of Uhud, so it must be given priority. Once this is established, whoever is required to wash due to a cause preceding death, such as a woman becoming pure from menstruation or postpartum bleeding, then being killed, is like the one in a state of major impurity due to the cause we have mentioned. If she were killed during her menstruation or postpartum bleeding, the washing would not be mandatory, because purity from menstruation is a condition for the washing, or for the necessitating cause, so the ruling is not established without it. As for if one accepts Islam and is then martyred, there is no washing upon him, because it was narrated that Usayrim of Banu 'Abd al-Ashhal accepted Islam on the Day of Uhud, then was killed, and he was not commanded to be washed.
Section: The adult and others are the same. This is the opinion of al-Shafi'i, Abu Yusuf, Muhammad, Abu Thawr, and Ibn al-Mundhir. Abu Hanifah said: The ruling of martyrdom is not established for one who is not an adult, because he is not among those considered for fighting. Our evidence is that he is a Muslim killed in the ranks of the polytheists by their fighting, resembling the adult. And because he is like the adult in the funeral prayer and washing if he is not killed by the polytheists, he resembles him in the lapse of that due to martyrdom. There were among the martyrs of Uhud Harithah ibn al-Nu'man and Umayr ibn Abi Waqqas, the brother of Sa'd, and both were young, and the hadith is general to all. What he mentioned is invalidated by women.
