what Sa'd ibn al-Rabi' has done?" A man said: "I will look for you, O Messenger of Allah." He looked and found him wounded, having a remaining spark of life. He said to him: "The Messenger of Allah (peace and blessings of Allah be upon him) commanded me to see if you are among the living or among the dead?" He said: "I am among the dead; convey my greeting to the Messenger of Allah (peace and blessings of Allah be upon him)." He mentioned the hadith, saying: "Then I did not stay long before he died." It is also narrated that Usayrim of the Banu 'Abd al-Ashhal was found fallen on the day of Uhud, and it was said to him: "What brought you here?" He said: "I embraced Islam, then I came." They were both from the martyrs of Uhud, and they fall under the general statement of the Prophet (peace and blessings of Allah be upon him): "Bury them with their blood and their garments." He did not wash them, nor did he pray over them, although they had spoken and died after the war had ended. In the story of the people of al-Yamamah, it is narrated from Ibn 'Umar that he walked among the slain and found Abu 'Aqil al-Unayfi. He said: "So I gave him water to drink, while he had fourteen wounds, all of which had reached a vital spot. The water flowed out from all his wounds, and he was not washed." In the Futuh al-Sham (Conquests of the Levant), it is narrated that a man said: "I took water, hoping to give a drink to my cousin if I found a spark of life in him. I found al-Harith ibn Hisham and intended to give him a drink, [but then a man looked at him, and he gestured for me to give him a drink], so I went to him to give him a drink, but another man looked at him and gestured for me to give him a drink. I did not reach him before they all died, and no one among them was singled out for washing or prayer, even though they had died after the end of the war.

Section: If a martyr's weapon recoils upon him and kills him, he is like one killed by the hands of the enemy. The Qadi said: He is to be washed and prayed over because he died at the hands of someone other than the polytheists, resembling one who was struck by such a thing outside of the battlefield. مَا فَعَلَ سَعْدُ بنُ الرَّبِيعِ؟ " فقال رَجُلٌ: أنا أَنْظُرُ لكَ يا رسولَ اللهِ. فنَظَرَ فوَجَدَهُ جَرِيحًا، به رَمَقٌ، فقال له: إنَّ رسولَ اللَّه -صلى اللَّه عليه وسلم- أمَرَنِى أن أَنْظُرَ في الأحْيَاءِ أَنْتَ أم في الأمْوَاتِ؟ قال: فأنا في الأمْواتِ، فأبْلِغْ رسولَ اللهِ -صلى اللَّه عليه وسلم- عَنِّى السَّلَامَ. وذَكَرَ الحَدِيثَ، قال: ثم لم أَبْرَحْ أن ماتَ (٥). وَرُوِىَ أنَّ أُصَيْرِمَ بَنِى (٦) عَبْدِ الأشْهَلِ وُجِدَ صَرِيعًا يومَ أُحُدٍ، فقِيلَ له: ما جاءَ بِكَ؟ قال: أسْلَمْتُ، ثم جِئْتُ. وهما من شُهَدَاءِ أُحُدٍ، دَخَلَا في عُمُومِ قَوْلِ النَّبِيِّ -صلى اللَّه عليه وسلم-: "ادْفِنُوهُمْ بِدِمَائِهِمْ وثِيَابِهِمْ". ولم يُغَسِّلْهم، ولم يُصَلِّ عليهم، وقد تَكَلَّمَا، وماتَا بعدَ انْقِضَاءِ الحَرْبِ. وفى قِصَّةِ أهْلِ اليَمَامَةِ، عن ابنِ عمرَ، أنَّه طَافَ في القَتْلَى، فوَجَدَ أبا عَقِيلٍ الأُنَيْفِىّ (٧) قال: فسَقَيْتُه مَاءً، وبه أرْبَعَةَ عَشَرَ جُرْحًا، كُلُّها قد خَلَصَ إلى مَقْتَلٍ، فخَرَجَ الماءُ مِن جرَاحَاتِه كُلِّها، فلم يُغَسَّلْ. وفي فتوحِ الشَّامِ، أنَّ رَجُلًا قال: أخَذْتُ مَاءً لَعَلِّى أَسْقِى ابنَ عَمِّى إن وَجَدْتُ به حَيَاةً، فوَجَدْتُ الحارثَ بن هِشامٍ، فأرَدْتُ أن أسْقِيَهُ، [فإذا رَجُلٌ يَنْظُرُ إليه، فأوْمَأَ لي أن أَسْقِيَهُ] (٨)، فَذَهَبْتُ إليه لأَسْقِيَهُ، فإذا آخَرُ يَنْظُرُ إليه، فأوْمَأَ لِى أن أسْقِيَهُ، فلم أَصِلْ إليه حتى ماتُوا كُلُّهُم (٩)، ولم يُفْرَدْ أحَدٌ منهم بِغُسْل ولا صَلَاةٍ، وقد مَاتُوا بعد انْقِضَاءِ الحَرْبِ.

فصل: فإن كان الشَّهِيدُ عادَ عليه سِلَاحُهُ فَقَتَلَهُ، فهو كالمَقْتُولِ بأيْدِى العَدُوِّ. وقال القاضي: يُغَسَّلُ، ويُصَلَّى عليه؛ لأنَّه ماتَ بغيرِ أَيْدِى المُشْرِكِينَ، أشْبَهَ ما لو أصابَهُ ذلك في غيرِ المُعْتَرَكِ. ولنَا، ما رَوَى أبو دَاوُدَ (١٠)، عن رَجُلٍ
