Al-Mughni by Ibn Qudama - Edited by Al-Turki

Translation · EN

He said: "Martyrdom is seven besides being killed." He added to what was mentioned in this report: "One who dies in a fire (30), one who dies of pleurisy (31), and a woman who dies in childbirth (32) is a martyr (33)." All of these are washed and the funeral prayer is performed over them, because the Prophet (may Allah bless him and grant him peace) refrained from washing the martyr on the battlefield due to what it entails of removing the blood that is legally pleasant, or because of the difficulty of washing them due to their large number, or due to the wounds they have, and none of that is present here.

Section: If the dead of the Muslims become mixed with the dead of the polytheists and they cannot be distinguished, the funeral prayer is performed over all of them, with the intention for the Muslims. Ahmad said: "He places them between himself and the Qiblah, then prays over them." This is the opinion of Malik and al-Sha'fi'i. Abu Hanifah said: "If the Muslims are the majority, he prays over them, otherwise he does not, because the consideration is given to the majority, as evidenced by the fact that in the land of the Muslims, Islam is apparent due to the large number of Muslims in it, and the opposite is the land of war (dar al-harb) due to the large number of disbelievers in it." Our evidence is that it was possible to pray over the Muslims without harm, so it is obligatory, just as if they were the majority,
