Al-Mughni by Ibn Qudama - Edited by Al-Turki
Volume 3 · Page 484Section

Translation · EN

Section: As for circumcision, it is not legislated, because it involves the removal of a part of his body. This is the opinion of the majority of scholars. It was related from some people that [the deceased] is to be circumcised, which was reported by Imam Ahmad. The first [opinion] is more appropriate for the reason we have mentioned. The hair of the deceased’s head is not to be shaved, because it is not part of the Sunnah during life, and it is only intended for adornment or acts of worship, neither of which is sought here.

Section: If his bone was mended with another bone and it set, then he died, it shall not be removed if it is pure. If it is impure and it is possible to remove it without mutilation, it shall be removed, because it is an impurity that one is capable of removing without harm. If it would lead to mutilation, it shall not be extracted, and it becomes in the status of an internal organ, as if he were alive. If there is a splint on the deceased whose removal would lead to mutilation, it is wiped over, just like the wiping of a living person's splint. If it does not lead to mutilation, it is removed and what is beneath it is washed. Ahmad said regarding a deceased whose teeth are bound with gold: If one is able to remove it without causing some of his teeth to fall out, he shall remove it; but if one fears that some of them might fall out, he shall leave it.

Section: Whoever is cramped, has a hump, or the like, and it is possible to straighten them through softening and hot water, one shall do so. If it is not possible except with force, one leaves it as it is. If it is in a state where it is impossible to leave it on the bier except in a manner that would be known as mutilation, it shall be left in a coffin or under a cover, similar to what is done with a woman, for that is more protective for him and more concealing of his state.

Section: It is recommended that something made of wood or palm stalks be left over the bier of a woman, like a dome, over which a garment is placed, so that it is more concealing for her. It has been narrated that Fatima, the daughter of the Messenger of Allah (peace and blessings of Allah be upon him), was the first person for whom this was done at her command.

Notes

(6) In [MS] A and M: "wa-al-awla" (and the first is more appropriate). (7) In the original [manuscript]: "bi-'asf" (with force). (8) Omitted from: A and M.
