Translation · EN

the fifth and the safiyy (the Prophet's special selection from the spoils), so he was forbidden from both types of charity, both mandatory and voluntary. His family, however, are lesser than him in status, and they are only entitled to the fifth of the fifth, so they were forbidden from one of the two types, which is the mandatory charity. It has been narrated from Ahmad that voluntary charity was not forbidden for him. Al-Maymuni said: I heard Ahmad say: The charity (37) that is not permissible for the Prophet (peace be upon him) and his household is: Sadaqat al-Fitr, Zakat on wealth, and charity that a man spends on a needy person intending thereby the pleasure of Allah the Almighty. As for other than that, it is not. Is it not said that every act of kindness is charity? Gifts used to be given to the Prophet (peace be upon him), and he would borrow, and that is not of the category of charity given out of need. The correct view is that this does not indicate the permissibility of charity for him; rather, he intended that what is not actually from the charity of wealth, such as loans, gifts, and the performance of (38) acts of kindness, is not forbidden for him. However, there is an indication in it of the equality between him and his family regarding the prohibition of voluntary charity for them, due to his statement that charity given to a needy person for the sake of Allah the Almighty is forbidden for both of them. This is voluntary charity, and thus there are two narrations regarding the prohibition of voluntary charity for his family. And Allah knows best.

430 - Issue: He said: (And neither to a wealthy person, and he is the one who possesses fifty dirhams or its equivalent in gold).

He means that a wealthy person is not given from the share of the poor and the needy. There is no disagreement on this among the scholars, because Allah the Almighty designated it for the poor and the needy, and the wealthy person is not included among them. The Prophet (peace be upon him) said to Mu'adh: "Inform them that they have a charity that is taken from their wealthy and returned to their poor" (1). And he said: "There is no share in it for a wealthy person, nor for a physically capable earner" (2). And he said:
