dates, and because that is the state of its perfection and storage, so he outputs from it, just as he estimates the fresh fruit in its state of ripeness, and he outputs from it once it has dried.

Section: The madhhab (school of thought) of Ahmad is that there is a tithe (ushr) on honey. Al-Athram said: Abu 'Abd Allah was asked: "Do you hold the view that there is Zakah on honey?" He said: "Yes. I hold the view that there is Zakah on honey, [it is] the tithe. 'Umar had collected Zakah from them." I asked: "Was that on the basis that they volunteered it?" He said: "No, rather he collected it from them." This is also narrated from 'Umar ibn 'Abd al-'Aziz, Makhul, al-Zuhri, Sulayman ibn Musa, al-Awza'i, and Ishaq. Malik, al-Shafi'i, Ibn Abi Layla, al-Hasan ibn Salih, and Ibn al-Mundhir said: There is no Zakah on it, because it is a liquid derived from an animal, resembling milk. Ibn al-Mundhir said: There is no report that is established, nor is there a consensus, regarding the obligation of charity on honey, so there is no Zakah on it. Abu Hanifah said: If it is in land subject to the tithe ('ushr land), then there is Zakah on it; otherwise, there is no Zakah on it. The rationale for the first [opinion] is what 'Amr ibn Shu'ayb narrated from his father, from his grandfather, that the Messenger of Allah (peace and blessings of Allah be upon him) used to take during his time from skins of honey—from every [ten skins] one skin of its average quality. Narrated by Abu 'Ubayd, al-Athram, and Ibn Majah. And from Sulayman ibn Musa, that Abu Sayyarah al-Muta'i said: I said, "O Messenger of Allah, I have bees." He said: "Pay their tithe." He said: "Protect their mountain for me then." So he protected it for him. Narrated by Abu 'Ubayd and Ibn Majah. And al-Athram narrated from Ibn Abi Dhubab, from his father, from his grandfather,
