and it was in the possession of the family of Umar ibn al-Khattab. It was narrated by Abu Dawud and al-Tirmidhi, who said: It is a hasan (good) hadith. Ibn 'Abd al-Barr said: It is the best thing narrated among the hadiths of Sadaqat. It contains: "If there are one hundred and twenty-one, there are three bint labun due upon them." And in another wording: "Up to one hundred and twenty; if it increases by one, then for every forty there is a bint labun, and for every fifty there is a hiqqa." Al-Daraqutni recorded it. He also recorded the hadith of Anas from the narration of Ishaq ibn Rahuyah, from al-Nadr ibn Shumayl, from Hammad ibn Salamah, who said: We took this book from Thumamah, who narrates it from Anas. It contains: "If it reaches one hundred and twenty-one, then for every forty there is a bint labun, and for every fifty there is a hiqqa." This is because for all the rest of what the Prophet (peace and blessings of Allah be upon him) set as a limit for the obligatory amount, if it increases by one, the obligatory amount changes; thus it is the same here. As for their statement that the obligatory amount does not change with the increase of a single unit, we say: This has not changed by the single unit alone, but rather it changed by it together with what preceded it, so it is analogous to the additional unit beyond ninety, sixty, and others. Ibn Mas'ud, al-Nakha'i, al-Thawri, and Abu Hanifah said: If the camels increase beyond one hundred and twenty, the assessment begins anew; for every five, there is a sheep up to one hundred and forty-five, in which there are two hiqqas and one bint makhad, up to one hundred and fifty, in which there are three hiqqas. The assessment is begun anew, with a sheep for every five; based on what was narrated that the Prophet (peace and blessings of Allah be upon him)

وكان عِنْدَ آل عمرَ بن الخَطَّابِ. رَوَاهُ أبو دَاوُدَ، والتِّرْمِذِىُّ (٣)، وقال: هو حَدِيثٌ حَسَنٌ. وقال ابنُ عَبْدِ البَرِّ: هو أحْسَنُ شَىْءٍ رُوِىَ فى أحادِيثِ الصَّدَقَاتِ. وفيه: "فَإذَا كَانَتْ إحْدَى وعِشْرِينَ ومِائةً، فَفِيهَا ثَلَاثُ بَنَاتِ لَبُونٍ". وفى لَفْظٍ: "إلَى عِشْرِينَ ومِائةٍ، فَإذَا زَادَتْ وَاحِدَةً ففى كُلِّ أَرْبَعِينَ بنْتُ لَبُونٍ، وفى كُلِّ خَمْسِينَ حِقَّةٌ". أَخْرَجَهُ الدَّارَقُطْنِىُّ (٤). وأَخْرَجَ حَدِيثَ أنَسٍ (٥)، من رِوايةِ إسحاقَ بن رَاهُويَه، عن النَّضْر بن شُمَيْلٍ (٦)، عن حَمَّادِ بن سَلَمَةَ، قال: أَخَذْنَا هذا الكتابَ مِن ثُمامَةَ يُحدِّثُه (٧) عن أَنَسٍ. وفيه: "فَإذَا بَلَغَتْ إحْدَى وعِشْرِينَ ومِائَةً، فَفِى كُلَّ أَرْبَعِينَ بِنْتُ لَبُونٍ، وفى كُلِّ خَمْسِينَ حِقَّةٌ". ولأنَّ سائِرَ ما جَعَلَهُ النَّبِىُّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- غَايَةً لِلْفَرْضِ، إذا زادَ عليه وَاحِدَةٌ تَغَيَّرَ الفَرْضُ، كذا هذا. وقَوْلُهم: إنَّ الفَرْضَ لا يَتَغَيَّرُ بِزِيادَةِ الوَاحِدَةِ. قُلْنا: وهذا ما تَغَيَّرَ بالوَاحِدَةِ وَحْدَها، وإنَّما تَغَيَّرَ بها مع ما قَبْلَها، فأشْبَهَتِ الوَاحِدَةَ الزَّائِدَةَ عن التِّسْعِينَ والسِّتِّينَ وغيرهما. وقال ابنُ مسعودٍ، والنَّخَعِىُّ، والثَّوْرِىُّ، وأبو حنيفةَ: إذا زادَتِ الإِبلُ على عِشْرِينَ ومِائَةٍ، اسْتُؤْنِفَت الفَرِيضَةُ، فى (٨) كلَّ خَمْسٍ شَاةٌ إلى خَمْسٍ وأرْبَعِينَ ومِائَةٍ، فيكونُ فيها حِقَّتانِ، وبِنْتُ مَخاضٍ، إلى خَمْسِينَ ومائةٍ، ففيها ثَلَاثُ حِقَاقٍ. وتُسْتَأْنَفُ الفَرِيضَةُ فى كلِّ خَمْسٍ شَاةٌ؛ لما رُوىَ أن النَّبِىَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-
