Translation · EN

of the two types for the other when there is harm, then it is all the more prohibited when there is even less. If the owner chooses to pay from the same type, and the poor person chooses to take from another type due to harm he incurs in taking the [original] type, the owner is not obligated to comply, because once he has performed what was made mandatory upon him, he is not burdened with anything else. And Allah knows best.

450 - Issue: He said: "There is no Zakat on a woman's jewelry if it is of the type she wears or lends out."

This is the manifest [position of the] Madhhab. This has also been narrated from Ibn Umar, Jabir, Anas, Aisha, and Asma, may Allah be pleased with them. This is the opinion of al-Qasim, al-Sha'bi, Qatadah, Muhammad ibn Ali, Amra, Malik, al-Shafi'i, Abu Ubayd, Ishaq, and Abu Thawr. Ibn Abi Musa mentioned from Ahmad another narration that it is subject to Zakat. This has also been narrated from Umar, Ibn Mas'ud, Ibn Abbas, Abdullah ibn Amr ibn al-As, Sa'id ibn al-Musayyib, Sa'id ibn Jubayr, Ata, Mujahid, Abdullah ibn Shaddad, Jabir ibn Zayd, Ibn Sirin, Maymun ibn Mihran, al-Zuhri, al-Thawri, and the People of Reason (Ashab al-Ra'y), based on the generality of his statement, peace be upon him: "On silver (riqah) there is a quarter of a tenth," and "There is no Sadaqah on less than five awaq." The implication is that there is Sadaqah on it if it reaches five awaq. Also from Amr ibn Shu'ayb, from his father, from his grandfather, who said: A woman from the people of Yemen came to the Messenger of Allah, peace and blessings of Allah be upon him, and with her was her daughter who had two bracelets of gold on her arms. He said: "Do you pay Zakat on this?" She said: No. He said: "Would it please you if Allah were to bracelet you with two bracelets of fire?"

النَّوْعَيْنِ عن الآخَرِ مع الضَّرَرِ، فمع غيرِه أوْلَى. وإن اخْتَارَ المالِكُ (٢٣) الدَّفْعَ من الجِنْسِ، واخْتَارَ الفَقِيرُ (٢٤) الأَخْذَ من غيره؛ لِضَرَرٍ يَلْحَقُه في أخْذِ الجِنْسِ، لم يَلْزَمِ المالِك إجَابَتُه؛ لأنَّه إذا أدَّى ما فُرِضَ (٢٥) عليه، لم يُكَلَّفْ سِوَاهُ. واللهُ أعلمُ.

٤٥٠ - مسألة؛ قال: (ولَيْسَ فِى حَلْىِ المَرْأَةِ زَكَاةٌ إذَا كَانَ مِمَّا تَلْبَسُهُ أو تُعِيرُهُ)

هذا ظَاهِرُ المَذْهَبِ. وَرُوِىَ ذلك عن ابْنِ عمرَ، وجابِرٍ، وأنسٍ، وعائشةَ، وأسماءَ، رَضِىَ اللهُ عنهم. وبه قال القاسمُ، والشَّعْبِيُّ، وقَتادَةُ، ومحمدُ بن عليٍّ، وعَمْرَةُ، ومَالِكٌ، والشَّافِعِيُّ، وأبو عُبَيْدٍ، وإسحاقُ، وأبو ثَوْرٍ. وذَكَرَ ابنُ أبي موسى [عن أحمدَ] (١) رِوَايَةً أُخْرَى، أنَّ (٢) فيه الزكاةَ. وَرُوِى ذلك عن عمرَ، وابنِ مسعودٍ، وابنِ عَبَّاسٍ، وعبدِ اللهِ بن عَمْرِو بن العَاصِ، وسَعِيدِ بن المُسَيَّبِ، وسَعِيدِ بن جُبَيْرٍ، وعَطاءٍ، ومُجاهِدٍ، وعبدِ اللَّه بن شَدَّادٍ، وجابِرِ بن زَيْدٍ، وابْنِ سِيرِينَ، ومَيْمُونِ بن مِهْرَانَ، والزُّهْرِيِّ، والثَّوْرِيِّ، وأصْحابِ الرَّأْىِ؛ لِعُمُومِ قَوْلِه عليه السَّلَامُ: "في الرِّقَةِ رُبْعُ العُشْرِ"، و "ولَيْسَ فِيمَا دُونَ خَمْسِ أَوَاقٍ صَدَقَةٌ" (٣). مَفْهُومُه أنَّ فيها صَدَقَةً إذا بَلَغَتْ خَمْسَ أوَاقٍ. وعن عَمْرِو بن شُعَيْبٍ، عن أبِيهِ، عن جَدِّه، قال: أتَتِ امْرَأَةٌ من أهْلِ اليَمَنِ رسولَ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-، ومعها ابْنَةٌ لها في يَدَيْها مَسَكَتَانِ (٤) من ذَهَبٍ، فقال: "هل تُعْطِينَ زَكَاةَ هذا؟ " قالت: لا. قال: "أَيَسُرُّكِ أن يُسَوِّرَكِ اللهُ بِسِوَارَيْنِ من
