and what follows it, according to the majority of scholars. Ubayda al-Salmani, Abu Mijlaz, and Suwayd ibn Ghafala said: One who travels after the month has entered shall not break his fast, because of the saying of Allah the Exalted: "So whoever among you witnesses the month, then let him fast it" (5). And this person has witnessed it. Our argument is the saying of Allah the Exalted: "So whoever among you is sick or on a journey, then an equal number of days elsewhere" (6). Ibn Abbas narrated: The Messenger of Allah (peace and blessings of Allah be upon him) set out in the year of the Conquest during the month of Ramadan, and he fasted until he reached al-Kadid (7), then he broke his fast, and the people broke their fast. Agreed upon (8). Also, because he is a traveler, breaking the fast is permitted for him, just as if he had traveled before the month, and the verse addresses the command to fast to those who witness the entire month, and this person did not witness it in its entirety. The third state: That one travels during a day of Ramadan. His ruling regarding the second day is like one who travels at night. Regarding the permissibility of breaking the fast on the day he travels, there are two narrations from Ahmad. One of them is that he may break his fast. This is the opinion of Amr ibn Shurahbil, al-Sha'bi, Ishaq, Dawud, and Ibn al-Mundhir, based on what Ubayd ibn Jubayr narrated, saying: I rode with Abu Basra al-Ghifari in a boat from Fustat during the month of Ramadan; he departed, then he brought his lunch near, and he did not pass the houses until he called for the dining cloth, then he said: Approach. I said: Do you not see the houses? Abu Basra said: Are you turning away from the Sunnah of the Messenger of Allah (peace and blessings of Allah be upon him)? So he ate. Narrated by Abu Dawud (10).
