'What is the matter with you?' He said: 'I have had intercourse with my wife while I was fasting.' The Messenger of Allah (peace and blessings of Allah be upon him) said: 'Can you find a slave to emancipate?' He said: 'No.' He said: 'Are you able to fast for two consecutive months?' He said: 'No.' He said: 'Can you find [the means to] feed sixty needy people?' He said: 'No.' The Prophet (peace and blessings of Allah be upon him) remained silent, and while we were in that state, the Prophet (peace and blessings of Allah be upon him) was brought a basket containing dates—the 'araq is the basket (6)—and he said: 'Where is the questioner?' He said: 'I am.' He said: 'Take this and give it as charity.' The man said: 'To someone poorer than me, O Messenger of Allah? For by Allah, there is no household between its two lava tracts poorer than my household.' The Prophet (peace and blessings of Allah be upon him) laughed until his canine teeth appeared, then said: 'Feed it to your family.' Muttafaq 'alayh (7). It is not permissible to consider the performance (ada) in this regard [equivalent to] the making up (qada); because the performance is linked to a specific time that defines it, while the making up is held in the liability (dhimmah), and prayer does not involve financial compensation, unlike our issue.

The third issue is that regarding intercourse other than in the vagina, if it is accompanied by ejaculation, there are two narrations from Ahmad. One of them is that he is liable for the expiation, and this is the opinion of Malik, 'Ata', al-Hasan, Ibn al-Mubarak, and Ishaq; because it is breaking the fast through intercourse, so it necessitates the expiation, like intercourse in the vagina. The second [narration] is: there is no expiation for it. This is the school of al-Shafi'i,

"ما لَكَ؟ ". قال: وَقَعْتُ على امْرَأَتِى وأنا صَائِمٌ. فقال رسولُ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-: "هل تَجِدُ رَقَبَةً تَعْتِقُها؟ " قال: لا، قال: "فَهَلْ تَسْتَطِيعُ أنْ تَصُومَ شَهْرَيْنِ مُتَتَابِعَيْنِ؟ " قال: لا، قال: "فَهَلْ تَجِدُ إطْعَامَ سِتِّينَ مِسْكِينًا؟ " قال: لا، قال: فمَكَثَ النَّبِىُّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-، فبَيْنَا نحن على ذلك أتِىَ النَّبِىُّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- بِعَرَقٍ فيه تَمْرٌ. والعَرَق: المِكْتَل (٦)، فقال: "أيْنَ السَّائِلُ؟ " فقال: أنا، قال: "خُذْ هذَا، فتَصَدَّقْ به" فقال الرَّجُلُ: على أفْقَرَ مِنِّى يا رسولَ اللهِ؟ فوَاللهِ ما بين لَابَتَيْهَا أهْلُ بَيْتٍ أفْقَرَ مِن أهْلِ بَيْتِى. فضَحِكَ النَّبِىُّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- حتى بَدَتْ أَنْيَابُه، ثم قال: "أَطْعِمْهُ أَهْلَكَ". مُتَّفَقٌ عليه (٧). ولا يجوزُ اعْتِبَارُ الأدَاءِ فى ذلك بالقَضاءِ؛ لأنَّ الأدَاءَ يَتَعَلَّقُ بِزَمَنٍ مَخْصُوصٍ يَتَعَيَّنُ به، والقَضَاءُ مَحَلُّه الذِّمَّةُ، والصلاةُ لا يَدْخُلُ فى جُبْرَانِها المالُ، بخِلافِ مَسْألَتِنَا. المسألة الثالثة، أنَّ الجِماعَ دُونَ الفَرْجِ، إذا اقْتَرَنَ به الإِنْزَالُ، فيه عن أحمدَ رِوَايَتَانِ؛ إحْدَاهُما، عليه الكَفَّارَةُ، وهذا قول مَالِكٍ، وعَطاءٍ، والحسنِ، وابنِ المُبارَكِ، وإسحاقَ؛ لأنَّه فِطْرٌ بجِمَاعٍ، فأوْجَبَ الكَفَّارَةَ، كالجِمَاعِ فى الفَرْجِ، والثانية: لا كَفَّارَةَ فيه. وهو مَذْهَبُ الشَّافِعِىِّ،
