Abu Hurayrah used to say: 'His fast is invalid,' and he narrated that from the Prophet, peace and blessings of Allah be upon him, but he later retracted it. Sa'id ibn al-Musayyab said: 'Abu Hurayrah retracted his legal opinion.' It was narrated from al-Hasan and Salim ibn Abdullah that they said: 'He completes his fast and makes it up.' From al-Nakha'i, in one narration: 'He makes it up for an obligatory fast but not for a voluntary one.' From 'Urwah and Tawus: 'If he knew of his janaba in Ramadan and did not perform ghusl until he reached morning, he is a breaker of the fast; but if he did not know, he is fasting.' Their argument is the hadith of Abu Hurayrah, which he retracted. Our evidence is what Abu Bakr ibn Abd al-Rahman ibn al-Harith ibn Hisham narrated, saying: 'My father and I went and entered upon 'Aishah, and she said: "I bear witness to the Messenger of Allah, peace and blessings of Allah be upon him, that he would reach the morning in a state of janaba from sexual intercourse, not from a wet dream, and then he would fast." Then we entered upon Umm Salamah, and she said the same. Then we came to Abu Hurayrah and informed him of that, and he said: "They are more knowledgeable about that; it was only Al-Fadl ibn 'Abbas who narrated it to me." (Agreed upon). Al-Khattabi said: "The best thing I have heard regarding the report of Abu Hurayrah is that it is abrogated; because sexual intercourse was forbidden for the fasting person after sleep, so when Allah permitted intercourse until the dawn rises, it became permissible for the person in a state of janaba to fast if he reaches the morning before performing ghusl." 'Aishah narrated that a man said to the Messenger of Allah, peace and blessings of Allah be upon him: "I reach the morning in a state of janaba while I intend to fast." The Messenger of Allah, peace and blessings of Allah be upon him, said: "And I reach the morning in a state of janaba while I intend to fast." The man said to him: "O Messenger of Allah, you are not like us; Allah has forgiven you your past and future sins." The Messenger of Allah, peace and blessings of Allah be upon him, became angry and said: "I truly hope that I am the most fearing of you toward Allah, and the most knowledgeable of you regarding what I must avoid." Narrated by Malik in his "Muwatta" and Muslim in his "Sahih".

أهْلِ الحَدِيثِ، ودَاوُدُ، فى أهْلِ الظَّاهِرِ. وكان أبو هُرَيْرَةَ يقول: لا صَوْمَ له. ويَرْوِى ذلك عن النَّبِىِّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-، ثم رَجَعَ عنه (١)، قال سَعِيدُ بن المُسَيَّبِ: رَجَعَ أبو هُرَيْرَةَ عن فُتْيَاهُ. وحُكِىَ عن الحسنِ، وسالِمِ بن عبدِ اللهِ، قالا (٢): يُتِمُّ صَوْمَهُ ويَقْضِى. وعن النَّخَعِىِّ فى رِوَايَةٍ: أنَّه (٣) يَقْضِى فى الفَرْضِ دُونَ التَّطَوُّعِ. وعن عُرْوَةَ، وطاوُسٍ: إن عَلِمَ بِجَنَابَتِه فى رمضانَ، فلم يَغْتَسِلْ حتى أصْبَح، فهو مُفْطِرٌ، وإن لم يَعْلَمْ. فهو صَائِمٌ. وحُجَّتُهم حَدِيثُ أبى هُرَيْرَةَ، الذى رَجَعَ عنه. ولَنا، ما رَوَى أبو بكرِ بن عبدِ الرحمنِ بن الحارِثِ بن هِشامٍ، قال: ذهبتُ أنا وأبى حتى دَخَلْنَا على عائشةَ، فقالتْ: أشْهَدُ على رسولِ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- إنْ كان لَيُصْبِحُ جُنُبًا، مِن جِمَاعٍ، مِن غيرِ احْتِلَامٍ، ثم يَصُومُه. ثم دَخَلْنَا على أُمِّ سَلَمَةَ، فقالتْ مثلَ ذلك، ثم أتَيْنَا أبا هُرَيْرَةَ، فأخْبَرْنَاهُ بذلك، فقال: هما أَعْلَمُ بذلك، إنَّما حَدَّثَنِيهِ الفَضْلُ بنُ عَبَّاسٍ. مُتَّفَقٌ عليه (٤). قال الخَطَّابِىُّ (٥): أحسنُ ما سمعتُ فى خَبَرِ أبى هُرَيْرَةَ أنَّه مَنْسُوخٌ؛ لأنَّ الجِماعَ كان مُحَرَّمًا على الصَّائِمِ بعدَ النَّوْمِ، فلمَّا أبَاحَ اللهُ الجِماعَ إلى طُلُوعِ الفَجْرِ، جازَ لِلْجُنُبِ إذا أصْبَحَ قبلَ أن يَغْتَسِلَ أن يَصُومَ. ورَوَتْ عائشةُ أن رَجُلًا قال لِرسولِ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-: إنِّى أُصْبِحُ جُنُبًا، وأنا أُرِيدُ الصِّيامَ. فقال رسولُ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-: "وَأَنَا أُصْبِحُ جُنُبًا، وَأَنَا أُرِيدُ الصِّيَامَ"، فقال له الرَّجُلُ: يا رسولَ اللهِ، إنَّك لستَ مِثْلَنَا، قد غَفَرَ اللهُ لك ما تَقَدَّمَ من ذَنْبِكَ وما تَأَخَّرَ. فغَضِبَ رسولُ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- وقال: "إنِّى لأَرْجُو أنْ أَكُونَ أَخْشَاكُمْ للهِ،
