And upon them is the make-up (qada') alone. We are not aware of any disagreement among the scholars regarding this, because they are in the position of a sick person who fears for his own self. If they fear for their children, they break their fast, and upon them is the make-up and the feeding of a poor person for every day. This is narrated from Ibn 'Umar, and it is the famous position in the school of al-Shafi'i. Al-Layth said: The expiation (kaffarah) is upon the nursing mother but not the pregnant woman. This is one of two narrations from Malik, because it is possible for the nursing mother to find a wet nurse for her child, unlike the pregnant woman, and because the pregnancy is connected to the pregnant woman, so the fear for it is like the fear for some of her own limbs. 'Ata', al-Zuhri, al-Hasan, Sa'id ibn Jubayr, al-Nakha'i, and Abu Hanifah said: There is no expiation upon them, based on what Anas ibn Malik—a man from Banu Ka'b—narrated from the Prophet, peace and blessings of Allah be upon him, that he said: "Indeed, Allah has relieved the traveler of half the prayer, and [has relieved] the pregnant and nursing woman of the fast—or—the fasting." By Allah, the Messenger of Allah, peace and blessings of Allah be upon him, said it, one of them or both of them. Narrated by al-Nasa'i and al-Tirmidhi, who said: This is a hasan (good) hadith. He did not order an expiation, and because it is an act of breaking the fast permitted for an excuse, so no expiation is required for it, just like breaking the fast due to illness. Our evidence is the saying of Allah Almighty: {And upon those who are able [to fast, but with hardship]—a ransom [as substitute] of feeding a poor person [each day]}. Both are included in the generality of the verse. Ibn 'Abbas said: It was a concession for the old man and the old woman, who are able to fast, to break their fast and feed a poor person in place of every day, and the pregnant and nursing woman if they fear for their children, they break their fast and feed [a poor person]. Narrated by Abu Dawud. That was also narrated from Ibn 'Umar, and there is no opponent to them among the Companions.
