Translation · EN

among the scholars, and the Prophet (peace and blessings of Allah be upon him) said: "Do not wear any garments touched by saffron or wars (a yellow dye)." It is unanimously agreed upon. Therefore, everything dyed with saffron or wars, or dipped in rose water, or perfumed with oud (aloeswood), is not to be worn by the person in ihram, nor is it to be sat upon or slept upon. Ahmad explicitly stated this. This is because it is a form of using it, so it resembles wearing it. Whenever one wears it or uses it, a ransom is due from him. This is the view of al-Shafi'i. Abu Hanifa said: If it is moist and touches his body, or dry and sheds [particles], then a ransom is due, otherwise not; because he is not considered to be perfumed. Our evidence is that he is prohibited from it due to the state of ihram, so a ransom is mandatory upon him for it, just as with the use of perfume on one's body. Furthermore, since he is a person in ihram who used a perfumed garment, a ransom is mandatory upon him just as in the case of the moist one. If he washes it until whatever of that was in it is gone, then there is no harm in it according to all scholars.

Section: If the scent of the garment is cut off due to the passage of time upon it, or because it was dyed with something else that overcame it, such that no scent radiates from it when water is sprinkled upon it, then there is no harm in using it, because the perfume has vanished from it. This is the view of Sa'id ibn al-Musayyib, al-Hasan, al-Nakha'i, al-Shafi'i, Abu Thawr, and the People of Opinion. This was also narrated from 'Ata' and Tawus. Malik disliked this unless it was washed and its color removed, because the substance of the saffron and the like remains in it. Our evidence is that he was only prohibited from it because of its scent, and it has vanished completely. As for if it has no scent at the present time, but is such that if water is sprinkled on it, its scent would waft, then a ransom is due; because it is perfumed with perfume, as evidenced by the fact that its scent appears when water is sprinkled upon it, and the water has no scent.

فى هذا بين العُلَمَاءِ، وقد قال النَّبِىُّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-: "لا تَلْبَسُوا مِنَ الثِّيَابِ شَيْئًا مَسَّهُ الزَّعْفَرَانُ، ولَا الوَرْسُ". مُتَّفَقٌ عليه (٢). فَكُلُّ ما صُبِغَ بِزَعْفَرَان أو وَرْسٍ، أو غُمِسَ فى ماءِ وَرْدٍ، أو بُخِّرَ بِعُودٍ، فليسَ لِلْمُحْرِمِ لُبْسُه، [ولا الجُلُوسُ عليه، ولا النَّوْمُ عليه. [نَصَّ أحمدُ عليه] (٣). وذلك لأنَّه اسْتِعْمَالٌ له، فأَشْبَهَ لُبْسَه] (٤). ومتى لَبِسَهُ، أو اسْتَعْمَلَهُ، فعليه الفِدْيَةُ. وبذلك قال الشَّافِعِىُّ. وقال أبو حنيفةَ: إن كان رَطْبًا يَلِى بَدَنَهُ، أو يَابِسًا يُنْفَضُ، فعليه الفِدْيَةُ، وإلَّا فلا؛ لأنَّه ليس بِمُتَطيِّبٍ. ولَنا، أنَّه مَنْهِىٌّ عنه لأجْلِ الإِحْرامِ فلَزِمَتْهُ الفِدْيَةُ به (٥)، كاسْتِعْمَالِ الطِّيبِ فى بَدَنِه. ولأنَّه مُحْرِمٌ اسْتَعْمَلَ ثَوْبًا مُطَيَّبًا، فلَزِمَتْهُ الفِدْيَةُ به كالرَّطْبِ. فإن غَسَلَهُ حتى ذَهَبَ ما فيه من ذلك، فلا بَأْسَ به عندَ جَمِيعِ العُلَمَاءِ.

فصل: وإن انْقَطَعَتْ رَائِحَةُ الثَّوْبِ، لِطُولِ الزَّمَنِ عليه، أو لِكَوْنِه صُبِغَ بغيرِه، فغَلَبَ عليه، بحيثُ لا يَفُوحُ له رَائِحَةٌ إذا رُشَّ فيه الماءُ، فلا بَأْسَ بِاسْتِعْمَالِه، لِزَوَالِ الطِّيبِ منه. وبهذا قال سَعِيدُ بنُ المُسَيَّبِ، والحسنُ، والنَّخَعِىُّ، والشَّافِعِىُّ، وأبو ثَوْرٍ، وأصْحابُ الرَّأى. ورُوِىَ ذلك عن عَطاءٍ، وطاوُسٍ. وكَرِهَ ذلك (٦) مَالِكٌ إلَّا أن يُغْسَلَ ويَذْهَبَ لَوْنُه؛ لأنَّ عَيْنَ الزَّعْفَرَانِ ونَحْوِه فيه. ولَنا، أنَّه إنَّما نُهِىَ عنه من أجْلِ رَائِحَتِه، وقد ذَهَبَتْ بِالكُلِّيَّةِ. فأمَّا إن لم يكنْ له رَائِحَةٌ فى الحالِ، لكن كان (٧) بحيثُ إذا رُشَّ فيه ماءٌ فَاحَ رِيحُه، ففيه الفِدْيَةُ؛ لأنَّه مُطَيَّبٌ (٨) بِطِيبٍ، بِدَلِيلِ أن رَائِحَتَهُ تَظْهَرُ عند رَشِّ الماءِ فيه، والماءُ لا رَائِحَةَ
