‘Umayr, what happened to the nughayr?" (37) It is a small bird. The implication of this is that he permitted keeping it in Medina, as he did not disapprove of that, and the sanctity of Mecca is greater than the sanctity of Medina, as evidenced by the fact that no one may enter it except while in the state of ihram.

Section: The hunting and trees of Wajj are permissible; it is a valley in Ta'if. The companions of al-Shafi'i said: It is a sanctuary because the Prophet (peace be upon him) said: "The hunting of Wajj and its trees are a sanctuary." Recorded by Ahmad in al-Musnad (38). Our position is that (39) the principle is permissibility, and the hadith is weak; Ahmad declared it weak. Abu Bakr al-Khallal mentioned this in his book, al-'Ilal (40).

604 - Issue; he said: (And if he is hindered by an enemy, he shall slaughter the hady [sacrificial animal] he has with him, and then exit the state of ihram).

The scholars are in consensus that if a person in ihram is hindered by an enemy, from the polytheists or others, and they prevent him from reaching the House [the Ka'bah], and he finds no safe route, he is entitled to exit the state of ihram (tahallul). Allah the Almighty has explicitly stated this in His saying: "But if you are hindered, then offer what can be obtained with ease of the sacrificial animal." (1) It is also established that the Prophet (peace be upon him) commanded his companions on the day they were hindered at al-Hudaybiyyah to slaughter, shave, and exit their state of ihram (2).

عُمَيْرٍ، مَا فَعَلَ النُّغَيْرُ؟ " (٣٧). وهو طَائِرٌ صَغِيرٌ. فظَاهِرُ هذا أنَّه أباحَ إمْسَاكَه بِالمَدِينَةِ، إذْ لم يُنْكِرْ ذلك، وحُرْمَةُ مَكَّةَ أعْظَمُ مِن حُرْمَةِ المَدِينَةِ، بِدَلِيلِ أنَّه لا يَدْخُلُها إلَّا مُحْرِمٌ.

فصل: صَيْدُ وَجٍّ وشَجَرُهُ مُبَاحٌ؛ وهو وَادٍ بالطَّائِفِ. وقال أصْحابُ الشَّافِعِىِّ: هو مُحَرَّمٌ؛ لأنَّ النَّبِيَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- قال: "صَيْدُ وَجٍّ وعِضَاهُها مُحرَّمٌ". رَوَاهُ أحمدُ، فى "المُسْنَدِ" (٣٨). ولَنا، أنَّ (٣٩) الأصْلَ الإباحَةُ، والحَدِيثُ ضَعِيفٌ، ضَعَّفَهُ أحمدُ. ذَكَرَهُ أبو بُكَرٍ الخَلَّالُ، فى كتابِ "العِلَلِ" (٤٠).

٦٠٤ - مسألة؛ قال: (وَإنْ حُصِرَ بِعَدُوٍّ، نَحَرَ مَا مَعَهُ مِنَ الهَدْىِ، وحَلَّ)

أجْمَعَ أهْلُ العِلْمِ علَى أنَّ المُحْرِمَ إذا حَصَرَهُ عَدُوٌّ مِن المُشْرِكِينَ، أو غيرِهم، فمَنَعُوهُ الوُصُولَ إلى البَيْتِ، ولم يَجِدْ طَرِيقًا آمِنًا، فله التَّحَلُّلُ. وقد نَصَّ اللَّه تعالى عليه بقَوْلِه: {فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ} (١). وثَبَتَ أنَّ النَّبِىَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- أَمَرَ أصْحَابَه يَوْمَ حُصِرُوا فى الحُدَيْبِيةِ أنْ يَنْحَرُوا، ويَحْلِقُوا، ويَحِلُّوا (٢).
