between Hajj and Umrah, for they both eliminate poverty and sins just as the bellows eliminate the dross of iron, gold, and silver. And there is no reward for an accepted Hajj (al-hajj al-mabrur) (40) except Paradise." Al-Tirmidhi (41) said: "This is a hasan sahih hadith." It is also reported from Abu Hurayrah, may Allah be pleased with him, that he said: The Messenger of Allah (peace be upon him) said: "Whoever comes to this House and does not behave obscenely (rafath) nor commit wickedness (fusuq), will return from his sins as on the day his mother bore him." It is agreed upon (42), and it is in al-Muwatta' (43).
539 - Issue: He said: (If he is a sick person from whom recovery is not expected, or an old man who cannot remain steady on the riding beast, he shall appoint someone to perform Hajj and Umrah on his behalf, and it shall suffice for him even if he is cured.)
The total of this is that whoever meets the conditions for the obligation of Hajj but is unable to perform it due to an obstacle from which there is no hope of removal—such as chronic disability (zamana), an illness from which no recovery is expected, or if he is of lean/frail constitution (1) and cannot remain steady on the riding beast except with unbearable hardship, or is a very old person, and others like him—whenever he finds someone to act as a substitute for him in Hajj and possesses the wealth to hire such a substitute, it becomes incumbent upon him. بَيْنَ الحَجِّ والعُمْرَةِ، فَإنَّهُما يَنْفِيَانِ الفَقْرَ والذُّنُوبَ، كَمَا يَنْفِى الكِيرُ خَبَثَ الحَدِيدِ والذَّهَبِ والفِضَّةِ، ولَيْسَ [لِلْحَجَّة الْمَبْرُورَةِ] (٤٠) ثَوَابٌ إلَّا الجَنَّةَ". قال التِّرْمِذِىُّ (٤١) هذا حَدِيثٌ حَسَنٌ صَحِيحٌ. وعن أبى هُرَيْرَةَ، رَضِيَ اللَّه عنه، قال: قال رسولُ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-: "مَنْ أَتَى هذَا البَيْتَ، فَلَمْ يَرْفُثْ ولَمْ يَفْسُقْ، رَجَعَ مِنْ ذُنُوبِهِ كَيَوْمِ وَلَدَتْهُ أُمُّهُ". مُتَّفَقٌ عليه (٤٢). وهو فى "المُوَطَّأِ" (٤٣).
٥٣٩ - مسألة؛ قال: (فَإنْ كَانَ مَرِيضًا لَا يُرْجَى بُرْؤُهُ، أو شَيْخًا لا يَسْتَمْسِكُ عَلَى الرَّاحِلَةِ، أقَامَ مَنْ يَحُجُّ عَنْهُ ويَعْتَمِرُ، وقَدْ أَجْزَأَ عَنْهُ وإنْ عُوفِىَ)
وجُمْلَةُ ذلك أنَّ مَن وُجِدَتْ فيه شَرائِطُ وُجُوبِ الحَجِّ، وكان عاجِزًا عنه لِمَانِعٍ مَأْيُوسٍ من زَوَالِه، كزَمَانَةٍ، أو مَرَضٍ لا يُرْجَى زَوَالُه، أو كان نِضْوَ (١) الخَلْقِ، لا يَقْدِرُ على الثُّبُوتِ على الرَّاحِلَةِ إلَّا بِمَشَقَّةٍ غيرِ مُحْتَمَلَةٍ، والشَّيْخُ الفَانِى، وَمَن كان مثلَه متى وَجَدَ مَنْ يَنُوبُ عنه فى الحَجِّ، ومالًا يَسْتَنِيبُه به، لَزِمَهُ ذلك. وبهذا قال أبو حنيفةَ، والشَّافِعِىُّ. وقال مالِكٌ: لا حَجَّ عليه، إلَّا أن يَسْتَطِيعَ بِنَفْسِه، ولا
