The ordering of halal status upon both of them is evidence that it is achieved by both, and because they are two rites followed by the state of halal, so it is achieved by them (16), just as with the tawaf and sa'y in the 'Umrah. According to Ahmad: that if one has thrown the pebbles at the Jamrah, one has entered the state of halal (18), and if one has intercourse after the Jamrah of al-'Aqabah, one owes a blood sacrifice (dam). He did not mention the shaving. This indicates that the state of halal is attained without shaving. This is the view of 'Ata', Malik, and Abu Thawr. It is the correct view, if Allah the Exalted wills, due to his statement in the hadith of Umm Salamah: "If you have thrown the pebbles at the Jamrah, then everything has become lawful for you, except for women" (19). Similarly, Ibn 'Abbas said this. Some (20) of our companions said: This is built (21) upon the disagreement regarding shaving; is it a rite or not? If we say: It is a rite, then the state of halal is achieved by it, and otherwise not.

651 - Issue; He said: (A woman should trim of her hair the amount of a fingertip)

The ungulah (fingertip) is the tip of the finger from the highest joint. What is prescribed for a woman is trimming, not shaving. There is no disagreement regarding that. Ibn al-Mundhir said: The people of knowledge have reached a consensus on this. That is because shaving for them is a mutilation (muthla). Ibn 'Abbas reported that the Messenger of Allah (peace and blessings of Allah be upon him) said: "There is no shaving for women; for women there is only trimming." Recorded by Abu Dawud (1). From 'Ali, who said: The Messenger of Allah (peace and blessings of Allah be upon him) forbade a woman from shaving her head. Recorded by al-Tirmidhi (2).
