in Makkah during the nights of Mina, on account of his providing water for the pilgrims. (Agreed upon) (5). Singling out al-'Abbas for the concession due to his excuse is evidence that there is no concession for anyone else. It is narrated from Ibn 'Abbas that he said: The Prophet (may Allah bless him and grant him peace) did not grant a concession to anyone to spend the night in Makkah, except for al-'Abbas (6), on account of his providing water for the pilgrims. Recorded by Ibn Majah (7). Al-Athram narrated from Ibn 'Umar that he said: No pilgrim should spend the night except in Mina. He used to send men who would not allow anyone to spend the night behind the 'Aqabah. This is because the Prophet (may Allah bless him and grant him peace) performed it as a ritual, and he said: "Take from me your rituals" (8).
Section: If he omits spending the night in Mina, then according to Ahmad, there is nothing incumbent upon him, but he has done wrong. This is the opinion of the scholars of ra'y (discretionary opinion), because the legislation did not state anything regarding it. According to another narration from him, he must feed something [in expiation]. He once made it light, then said: Some of them have said: There is nothing upon him. Ibrahim said: A blood sacrifice is incumbent upon him. He laughed, then said: A blood sacrifice at once? You have made it severe (9). I said: Is there nothing but to feed something? He said: Yes, he feeds something, dates or the like. According to this, whatever he gives as charity is sufficient, and there is no difference between one night or more; [because there is no] (10) set estimation for it. According to another narration from him: For the three nights, a blood sacrifice is due, because of the statement of Ibn 'Abbas: Whoever omits something of his rituals, [then he must slaughter] (11) a sacrificial animal. Regarding [the omission of] less than the three [nights], there are three narrations [and 'Ata' said: For every pebble, a dirham is due] (12). This is the opinion of al-Shafi'i (13). This has no counterpart, for we know of no requirement of a dirham or half a dirham for omitting any of the rituals, so obligating it without a text is arbitrary and has no basis. And Allah knows best.
656 - Issue; He said: (Then, when the next day comes and the sun has passed the meridian, he stones the first Jamrah with seven pebbles, saying takbir with each pebble, standing at it, throwing (1), and supplicating. Then he stones the middle Jamrah (2) with seven pebbles, also saying takbir and supplicating. Then he stones the Jamrat al-'Aqabah with seven pebbles, and he does not stand at it)
We have mentioned that the total of what the pilgrim throws is seventy pebbles. Seven of them he throws on the Day of Sacrifice, after the sun rises. The rest of them are during the three days of Tashriq, after the sun passes the meridian, twenty-one pebbles each day for the three Jamarat. He begins with the first Jamrah, which is the farthest of the Jamarat from Makkah and is adjacent to the Mosque of al-Khayf. He places it to his left, faces the Qiblah, and throws at it with seven pebbles [as we described regarding the Jamrat al-'Aqabah. Then he advances from it to a place where the pebbles will not reach him, and stands for a long time supplicating to Allah, the Almighty] (3), raising his hands. Then he advances to the middle [Jamrah], places it to his right, faces the Qiblah, and throws at it with seven pebbles, and he performs the same standing and supplication as he did at the first. Then he throws the Jamrat al-'Aqabah.
