and more insightful in knowledge; thus, their judgment is a proof against others, just as the scholar is in relation to the layman. The judgment of theirs which has reached us is [for the hyena, there is a ram] (34). Umar, Ali, Jabir, and Ibn Abbas ruled by it. It is reported regarding Jabir that the Prophet (peace and blessings of Allah be upon him) decreed a ram for the hyena when a muhrim (pilgrim in a state of ihram) hunts it. This was recorded by Abu Dawud and Ibn Majah (35). It is reported from Jabir, from the Prophet (peace and blessings of Allah be upon him), that he said: "For the hyena, if the muhrim kills it, there is a ram; for the gazelle, a sheep; for the rabbit, an 'anaq (a young female goat) (36); and for the jerboa (37), a jafrah (a young weaned goat)." Abu al-Zubayr said: The jafrah is one that has been weaned and has grazed. This was recorded by al-Daraqutni (38). Ahmad said: The Messenger of Allah (peace and blessings of Allah be upon him) judged a ram for the hyena. Ata', al-Shafi'i, Abu Thawr, and Ibn al-Mundhir held this view. Al-Awza'i said: The scholars in the Levant used to consider it among the beasts of prey and disliked eating it. This is [what] analogy [dictates], yet following the Sunnah and the traditions (athar) is more appropriate. Regarding the wild ass, there is a cow. This is reported from Umar (may Allah be pleased with him). Urwah, Mujahid, and al-Shafi'i held this view. According to Ahmad, there is a camel for it. This is reported from Abu Ubaydah and Ibn Abbas. Ata' and al-Nakha'i held this view. Regarding the wild cow, there is a cow. This is reported from Ibn Mas'ud, Ata', Urwah, Qatadah, and al-Shafi'i. For the deer (ayyil), there is a cow; this was stated by Ibn Abbas. Our companions said: For the ibex (wa'l) and the mountain goat (thaytal), there is a cow, like the deer (40). For the wild mountain sheep (arwa), there is a cow. Ibn Umar stated this. The Qadi said: For it, there is an 'adhab, which is from the young of the cow, one that has reached the age where it can be grasped by its horn, but has not yet reached the age of being a jadha' (a young animal). This was narrated from al-Azhari.
