and Ishaq, Abu Thawr, and the People of Opinion (Ashab al-Ra'y). Al-Tirmidhi said: "The scholars have unanimously agreed upon this." Imam Ahmad narrated from Muhammad ibn Ka'b al-Qurazi, who said: The Messenger of Allah (peace and blessings of Allah be upon him) said: "I desire to renew a covenant in the hearts of the believers: whichever child is taken to Hajj by his family and dies, it suffices for him; but if he reaches maturity, the Hajj is obligatory upon him. And whichever slave is taken to Hajj by his family, and dies, it suffices for him; but if he is manumitted, the Hajj is obligatory upon him." This was narrated by Sa'id in his "Sunan" and by al-Shafi'i in his "Musnad," as a statement of Ibn Abbas. This is because Hajj is a physical act of worship, which he performed before its time of obligation, so that does not prevent its obligation upon him when its time comes, just as if he were to pray before the time and then reached maturity within the time.
Section: If the child reaches maturity, or the slave is manumitted while at Arafat, or before it, while not in the state of ihram, and they enter into ihram, stand at Arafat, and complete the rites, it suffices them for the Hajj of Islam. We know of no disagreement regarding this because they have not missed any of the pillars of Hajj, nor did they perform any of them before they became obligatory. If the maturity or manumission occurs while they are in the state of ihram, it also suffices them for the Hajj of Islam. This was stated likewise by Ibn Abbas. This is the school of al-Shafi'i and Ishaq. Al-Hasan stated it regarding the slave, while Malik said: "It does not suffice them," and Ibn al-Mundhir chose this view. The People of Opinion (Ashab al-Ra'y) said: "It does not suffice the slave. As for the child, if he renews the ihram after experiencing a wet dream before the standing (at Arafat), it suffices him; otherwise, it does not." This is because their ihram was not initiated as an obligation, so it cannot suffice for the obligation, just as if they remained in their original state. Our evidence is that he reached the standing (at Arafat) as a free person of age, so it suffices him, just as if he had entered into ihram at that very moment. Ahmad said: Tawus said, from Ibn Abbas: "If the slave is manumitted at Arafat, his Hajj suffices for him."
