four [defects] we know of no disagreement among scholars regarding their prohibition. The ruling is established for that which has a defect greater than these by way of notification (al-tanbih). Thus, the blind animal is not permitted, because blindness is more significant than the one-eyed defect. With blindness, the sinking of the eye is not considered, because it impairs walking with the herd and sharing in fodder more than lameness does. It is also not permitted to sacrifice an animal from which a prized body part has been removed, such as the fat tail (alya), because that is more extreme in impairing the intended purpose than the loss of the fatty tissue of the eye. As for the adba' (the clipped animal), which is one that has lost half of its ear or horn, it does not suffice. This is the opinion of Abu Yusuf and Muhammad regarding the clipped ear. It is narrated from Ahmad that it does not suffice if a third of its ear is lost, which is the opinion of Abu Hanifa. It is narrated from Ali, Ammar, Sa'id ibn al-Musayyib, and al-Hasan that the animal with a broken horn does suffice, because the loss of that does not affect the meat, and therefore it suffices, like the hornless animal (jamma'). Malik said: 'If it bleeds, it is not permitted; otherwise, it is.' Our evidence is what Ali (may Allah be pleased with him) narrated, saying: 'The Messenger of Allah (peace and blessings of Allah be upon him) forbade sacrificing an animal that is adba' in ear and horn.' Recorded by al-Nasa'i and Ibn Majah (6). Qatada said: 'I asked Sa'id ibn al-Musayyib, and he said: Yes, the adb (clipping) is half or more than that.' The statement of Ali (may Allah be pleased with him) and those who agreed with him is interpreted as meaning that the breaking of less than half does not prohibit it.

Section: The castrated animal (khasi) suffices, whether its testicles were cut off or it was maslul (one whose testicles were extracted), or mawju' (one whose testicles were crushed), because the Prophet (peace and blessings of Allah be upon him) sacrificed two horned, white-and-black rams that were mawju' (8). الأرْبَعُ لا نَعْلَمُ بنِ أهْلِ العِلْمِ خِلَافًا فى مَنْعِهَا. ويَثْبُتُ الحُكْمُ فيما فيه نَقْصٌ أكْثَرُ مِن هذه العُيُوبِ بطَرِيقِ التَّنْبِيهِ، فلا تجوزُ العَمْياءُ؛ لأنَّ العَمَى أكْثَرُ مِن العَوَرِ، ولا يُعْتَبَرُ مع العَمَى انْخِسافُ العَيْنِ؛ لأنَّه يُخِلُّ بِالمَشْىِ مع الغَنَمِ، والمُشارَكَةِ فى العَلَفِ، أكْثَرَ مِن إخْلالِ العَرَج. ولا يجوزُ ما قُطِعَ منها عُضْوٌ مُسْتَطابٌ، كالألْيَةِ؛ لأنَّ ذلك أَبْلَغُ فى الإخْلالِ بِالمَقْصُودِ مِن ذَهابِ شَحْمَةِ العَيْنِ. فأمَّا العَضْباءُ، وهى ما ذَهَبَ نِصْفُ أُذُنِها أو قَرْنِها، فلا تُجْزِئُ. وبه قال أبو يوسفَ ومحمدٌ فى عَضْباءِ الأُذُنِ. وعن أحمدَ: لا تُجْزِئُ ما ذَهَبَ ثُلُثُ أُذُنِها. وبه قال أبو حنيفةَ. وَرُوِىَ عن علىٍّ، وعَمَّارٍ، وسَعِيدِ بن المُسَيَّبِ، والحسنِ، تُجْزِئُ المَكْسُورَةُ القَرْنِ؛ لأنَّ ذَهابَ ذلك لا يُؤَثِّرُ فى اللَّحْمِ، فأجْزَأَتْ، كالجَمَّاء. وقال مالِكٌ: إنْ كان يُدْمِى، لم يَجُزْ، وإلَّا جازَ. ولَنا، ما رَوَى علىٌّ، رَضِىَ اللهُ عنه، قال: نَهَى رسولُ اللهِ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- أنْ يُضَحَّى بِأعْضَبِ الأُذُنِ والقَرْنِ. رواه النَّسائِىُّ وابنُ مَاجَه (٦). قال قَتَادَةُ: فسألتُ سَعِيدَ بنَ المُسَيَّبِ، فقال: نعم، العَضَبُ النِّصْفُ فأكْثَرُ مِن ذلك. ويُحْمَلُ قَوْلُ علىٍّ، رَضِىَ اللَّه عنه، ومَنْ وافَقَه، على أنَّ كَسْرَ ما دونَ النِّصْفِ لا يَمْنَعُ.

فصل: ويُجْزِئُ (٧) الخَصِىُّ، سَواءٌ كان ممَّا قُطِعَتْ خَصْيَتاه أو مَسْلُولًا، وهو الذى سُلَّتْ بَيْضَتاه، أو مَوْجُوءًا، وهو الذى رُضَّتْ بَيْضَتاه؛ لأنَّ النَّبِىَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- ضَحَّى بِكَبْشَيْنِ أمْلَحَيْنِ مَوْجُوءَيْنِ (٨). والمَرْضُوضُ كالمَقْطُوعِ. ولأنَّ ذلك
