the limb is not a prized one, and its loss does not affect its fatness, the abundance of meat, and its quality, which is the intended purpose. We know of no disagreement regarding this. The jamma' (naturally hornless animal) suffices, which is the one that was not created with a horn. It is narrated from Ibn Hamid that it does not suffice, because the absence of a horn is more significant than the loss of half of it. The preferred view is that it does suffice, because the horn is not an intended objective, and no prohibition has been reported concerning that which it lacks. The sam'a' (naturally earless animal) suffices, which is the one that was not created with ears, or was created with small ears of that nature. The batra' (naturally tailless animal) suffices, which is the one whose tail was cut, or is similar to that.
Section: It is disliked (makruh) to sacrifice an animal with a slit ear, or one from which a portion of its ear has been cut, or one that has a defect from these defects that do not prevent the validity of the sacrifice; because of the statement of Ali (may Allah be pleased with him): "We were commanded to carefully inspect the eyes and ears. Do not sacrifice an animal that is muqabala (the tip of its ear cut), mudabara (the rear of its ear cut), kharqa' (its ear slit), or sharqa' (its ear split)." Zuhayr said: I asked Abu Ishaq: What is muqabala? He said: "The tip of the ear is cut off." I said: What is mudabara? He said: "The back of the ear is cut." I said: What is kharqa'? He said: "The ear is slit." I said: What is sharqa'? He said: "The ear is split by a brand mark." Recorded by Abu Dawud and al-Nasa'i (9). Al-Qadi said: The kharqa' is one whose ear has been perforated. The sharqa' is one whose ear is split and remains like two sections (10). This is a prohibition of dislike (tanzih), and the sacrifice is valid with them; we know of no disagreement regarding this.
Section: It is recommended for one who arrives in Mecca to perform the circumambulation (tawaf) of the House; because the circumambulation of the House is a prayer,

العُضْوَ غيرُ مُسْتَطابٍ، وذَهابُه يُؤَثِّرُ فى سِمَنِه، كثْرَةِ اللَّحْمِ وطِيبِه، وهو المَقْصُودُ. ولا نَعْلَمُ فى هذا خِلَافًا. وتُجْزِئُ الْجَمَّاءُ، وهى التى لم يُخْلَقْ لها قَرْنٌ. وحُكِىَ عن ابنِ حامِدٍ أنَّها لا تُجْزِئُ؛ لأنَّ عَدَمَ القَرْنِ أكْثَرُ مِن ذَهابِ نِصْفِه. والأوْلَى أنَّها تُجْزِئُ؛ لأنَّ القَرْنَ ليس بِمَقْصُودٍ، ولا وَرَدَ النَّهْىُ عما عُدِمَ فيه. وتُجْزِئُ الصَّمْعاءُ، وهى التى لم يُخْلَقْ لها أُذُنٌ، أو خُلِقَتْ لها أُذُنٌ صَغِيرَةٌ كذلك. وتُجْزِئُ البَتْرَاءُ، وهى المَقْطُوعَةُ الذَّنَبِ كذلك.
فصل: ويُكْرَهُ أنْ يُضَحِّى بِمَشْقُوقَةِ الأُذُنِ، أو ما قُطِعَ منها شىءٌ، أو ما فيها عَيْبٌ من هذه العُيُوبِ التى لا تَمْنَعُ الإِجْزَاءَ؛ لِقَوْلِ علىٍّ، رَضِىَ اللَّه عنه: أُمِرْنَا أنْ نَسْتَشْرِفَ العَيْنَ والأُذُنَ. لا يُضَحِّى بمُقابَلَةٍ، ولا مُدابَرَةٍ، ولا خَرْقاءَ، ولا شَرْقاءَ. قال زُهَيْرٌ: قلتُ لأبى إسحاقَ: ما المُقابَلَةُ؟ قال: يُقْطَعُ طَرَفُ الأُذُنِ. قُلْتُ: فما المُدابَرَةُ؟ قال: يُقْطَعُ مُؤَخَّرُ الأُذُنِ. قلتُ: فما الخَرْقاءُ؟ قال: يُشَقُّ الأُذُنُ. قلت: فما الشَّرْقاءُ؟ قال: يَشُقُّ أُذُنَهَا السِّمَةُ. رواه أبو داوُدَ، والنَّسائِىُّ (٩). قال القاضى: الخَرْقاءُ التى انْثَقَبَتْ أُذُنُها. والشَّرْقاءُ التى تُشَقُّ أُذُنُها وتَبْقَى كَالشَّاخِتَيْنِ (١٠). وهذا نَهْىُ تَنْزِيهٍ. ويَحْصُلُ الإِجزاءُ بها، لا نَعْلَمُ فى هذا خِلافًا.
فصل: يُسْتَحَبُّ لمن أتَى مَكَّةَ أنْ يَطُوفَ بِالبَيْتِ؛ لأنَّ الطَّوافَ بِالبَيْتِ صلاةٌ،
