He needs to sell her. He said: He should sell her as being an untainted slave (sadhiqa). It was said to him: But she is worth thirty thousand dirhams, and if she is sold as an untainted slave, she is worth twenty dinars. He replied: She should not be sold except as an untainted slave. The basis for this is what Abu Umamah narrated from the Prophet, peace and blessings of Allah be upon him, that he said: "The sale of singing girls, their prices, and their earnings are not permissible." Al-Tirmidhi [10] said: We do not know this except from the hadith of Ali ibn Yazid, and the scholars have spoken about him. Ibn Majah [11] also narrated it. This is interpreted as applying to selling them for the purpose of singing. As for their value derived from other than singing, it does not become void, just as fruit juice is not prohibited from being sold for purposes other than making wine, despite its potential to be made into wine.

Section: It is not permissible to sell wine, nor to appoint an agent (tawkil) to sell it, nor to purchase it. Ibn al-Mundhir said: The scholars have reached a consensus that the sale of wine is not permissible. Abu Hanifa said: It is permissible for a Muslim to appoint a Dhimmi (protected non-Muslim subject) as an agent to sell and buy it. This is incorrect; for Aisha narrated that the Prophet, peace and blessings of Allah be upon him, said: "Trade in wine has been prohibited [12]." From Jabir, he heard the Prophet, peace and blessings of Allah be upon him, during the year of the Conquest while he was in Makkah saying: "Indeed [13], Allah and His Messenger have prohibited the sale of wine, dead meat (mayta), swine, and idols." احتاجَ إلى بَيْعِها. قال: يَبِيعُها على أنَّها ساذِجَةٌ. فقيل له: فإنّها تُساوِى ثلاثينَ ألْفَ دِرْهَمٍ، فإذا بِيعَتْ ساذِجَةً تُساوِى عِشْرِينَ دِينارًا. قال: لا تُباعُ إلّا على أنَّها ساذِجَةٌ. ووَجْهُ ذلك ما رَوَى أبو أُمامَةَ، عن النَّبِيِّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ-؛ أنَّه قال: "لَا يَجُوزُ بَيْعُ المُغَنِّيَاتِ، وَلَا أثْمانُهُنَّ، وَلَا كَسْبُهُنَّ". قال التِّرْمِذِيُّ (١٠): هذا لا نَعْرِفه إلَّا مِن حَدِيثِ عَلِيِّ بن يَزِيدَ، وقد تَكَلَّمَ فيه أهلُ العِلْمِ. ورواه ابنُ مَاجَه (١١). وهذا يُحْمَلُ على بَيْعِهِنَّ لأجلِ الغِناءِ، فأمّا مالِيَّتُهُنَّ الحاصِلَةُ بغيرِ الغِناءِ فلا تَبْطُلُ، كما أنَّ العَصِيرَ لا يَحْرُمُ بَيْعُه لغيرِ الخَمْرِ، لصَلَاحِيَتِه للخَمْرِ.

فصل: ولا يجوزُ بَيْعُ الخَمْرِ، ولا التَّوْكِيلُ فى بَيْعِه، ولا شراؤه. قال ابنُ المُنْذِرِ: أجْمَعَ أهْلُ العِلْمِ على أنَّ بَيْعَ الخَمْرِ غيرُ جائزٍ. وقال أبو حنيفةَ: يجوزُ للمُسْلِمِ أنْ يُوَكِّلَ ذِمِّيًّا فى بَيْعِها وشِرائِها. وهو غيرُ صَحِيحٍ؛ فإنَّ عائِشَةَ رَوَتْ، أنَّ النَّبيَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- قال: "حُرِّمَتِ التِّجَارَةُ فِى الْخَمْرِ" (١٢). وعن جابِرٍ، أنَّه سَمِعَ النَّبِيَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- عامَ الفَتْحِ، وهو بمَكَّةَ، يقولُ: "إنَّ (١٣) اللهَ وَرَسُولَهُ حَرَّمَا بَيْعَ الْخَمْرِ وَالْمَيْتَةِ وَالْخِنْزِيرِ والأصْنَامِ". فقيل: يا رسولَ اللهِ، أرأَيْتَ شُحُومَ المَيْتَةِ، فإنَّه
