Section: Ibn Aqil mentioned that it is permissible to lease a well to draw water from it for known days; because the air and depth of the well contain a type of benefit through the passage of the bucket within it. As for the water itself, it is taken based on the principle of permissibility.
Section: It is permissible to lease a cheetah, a hawk, or a falcon for hunting for a known period, because it contains a permissible benefit that may be lent to him, so its lease is permissible, like a beast of burden. It is permissible to lease books of knowledge that are permissible to be sold, in order to benefit from them through reading and copying from them, for the reason we have mentioned. It is also permissible to lease a scroll containing fine calligraphy to write upon and to use as a model for that purpose.
Section: Things that may not be leased are of several types:
One of them is that which cannot be benefited from while its entity remains, such as food, drink, and a candle meant to be lit; because a lease is a contract over benefits, and these cannot be benefited from except by consuming their entity. If one leases a candle to light it, then returns the remainder, pays for what was consumed, and pays the rent for the remainder, it is invalid; because it combines a sale and a lease, and what the sale applies to is unknown. When the item sold is unknown, the item leased is also unknown, and thus both contracts are invalid. If one leases a candle to adorn oneself with and returns it without lighting any part of it, it is not permissible; because this is not a benefit recognized in the Shari'ah, so spending wealth for it is folly, and taking it is consuming wealth unjustly. Therefore, it is not permissible, just as if one were to lease [bread to look at, and similarly if one were to lease] food to adorn one's table with and then return it, it is not permissible for the reason we have mentioned. The same applies to all other things. It is not valid to lease things that do not last among flowers, such as roses, violets, Persian basil, and the like, to smell them; because they perish quickly, so they resemble food items. It is not permissible to lease sheep, camels, or cattle to obtain their milk, nor to have them nurse one's offspring or the like, nor to lease them to obtain their wool or hair.

فصل: وذَكَرَ ابنُ عقيلٍ، أنَّه يجوزُ اسْتِئْجارُ البِئْرِ، لِيَسْتَقِىَ منها أيّامًا مَعْلُومةً؛ لأنَّ هَواءَ البِئْرِ وعُمْقَها فيه نوعُ انْتِفاعٍ بمُرُورِ الدَّلْوِ فيه، وأمَّا نَفْسُ الماءِ، فيُؤْخَذُ على أصْلِ الإِبَاحةِ.
فصل: ويجوزُ اسْتِئْجارُ الفَهْدِ والبازِي والصَّقْرِ للِصَّيْدِ، في مُدَّةٍ مَعْلُومةٍ؛ لأنَّ فيه نَفْعًا مُباحًا تجوزُ إعَارَتُه له، فجازَتْ إجَارَتُه له، كالدَّابَّةِ. وتجوزُ إجارَةُ كُتُبِ العِلْمَ، التي يجوزُ بَيْعُها للانْتِفاعِ بها في القِرَاءةِ فيها، والنَّسْخِ منها؛ لما ذَكَرْناه. وتجوزُ إجَارةُ دَرْجٍ فيه خَطٌّ حَسَنٌ، يَكْتُبُ عليه، ويَتَمَثَّلُ منه؛ لذلك.
فصل: وما لا تجوزُ إجَارَتُه أقْسَامٌ:
أحدها، ما لا يُمْكِنُ الانْتِفاعُ به مع بَقَاءِ عَيْنِه، كالمَطْعُومِ والمَشْرُوبِ، والشَّمْعِ لِيُشْعِلَه؛ لأنَّ الإِجَارةَ عَقْدٌ على المَنافِعِ، وهذه لا يُنْتَفَعُ بها إلَّا بإتْلَافِ عَيْنِها، فإن اسْتَأْجَرَ شَمْعةً يُسْرِجُها، ويَرُدُّ بَقِيَّتَها، وثَمَنَ ما ذَهَبَ، وأجْرَ الباقِي، كان فاسِدًا؛ لأنَّه يَشْمَلُ بَيْعًا وإجارَةً، وما وَقَعَ عليه البَيْعُ مَجْهُولٌ، وإذا جُهِلَ المَبِيعُ جُهِلَ المُسْتَأْجَرُ أيضًا، فيَفْسدُ العَقْدانِ، ولو اسْتَأْجَرَ شَمْعًا لِيَتَجَمَّلَ به، ويَرُدَّه من غيرِ أن يُشْعِلَ منه شَيْئًا، لم يَجُزْ؛ لأنَّ ذلك ليس بمَنْفَعةٍ مَرْعِيَّةٍ في الشَّرْعِ، فبَذْلُ المالِ فيه سَفَهٌ، وأخْذُهُ أكْلُ مالٍ بالباطِلِ، فلم يَجُزْ، كما لو اسْتَأْجَرَ [خُبْزًا لِيَنْظُرَ إليه، وكذلك لو اسْتَأْجَرَ] (٢٥) طَعَامًا لِيَتَجَمَّلَ به على مائِدَتِه، ثم يَرُدَّه، لم يَجُزْ؛ لما ذَكَرْنا. وهكذا سائِرُ الأشْياءِ، ولا يَصِحُّ اسْتِئْجارُ ما لا يَبْقَى (٢٦) من الرَّيَاحِينِ، كالوَرْدِ والبَنَفْسَجِ والرَّيْحانِ الفارِسِيِّ، وأشْبَاهِه، لِشَمِّها؛ لأنَّها تَتْلَفُ عن قُرْبٍ، فأشْبَهَتِ المَطْعُوماتِ. ولا يجوزُ اسْتِئْجارُ الغَنَمِ، ولا الإِبِلِ والبَقَرِ، لِيَأْخُذَ لَبَنَها، ولا لِيَسْتَرْضِعَها لسِخالِه (٢٧) ونحوها، ولا اسْتِئْجارُها لِيَأْخُذَ صُوفَها، ولا شَعْرَها،
