and mummy (2), naphtha, kohl, stone pots (3), rubies, clay quarries (4), and similar items, cannot be owned through revival (ihya'), nor is it permissible for them to be granted as a fief (iqta') to any of the people, nor may they be reserved to the exclusion of the Muslims; because this contains harm to the Muslims and restriction upon them, and because the Prophet (peace and blessings of Allah be upon him) granted Abyad ibn Hammal the salt mine, but when it was said to him that it was like a perpetual water source ('idd) (5), he rescinded it. Such is what Ahmad said. Abu 'Ubayd, Abu Dawud, and al-Tirmidhi (6) recorded with their chains of narration from Abyad ibn Hammal that he requested from the Messenger of Allah (peace and blessings of Allah be upon him) the salt at Ma'rib. When he left, it was said: O Messenger of Allah, do you know what you have granted him? You have only granted him the perpetual water source. So he took it back from him. He said: I said: O Messenger of Allah, what is the protected area (hima) of the Arak trees? He said: "Whatever the camels' hooves cannot reach (9)." This is a gharib (strange/rare) hadith. It is also narrated with a wording from him that he said: "There is no hima in Arak." Sa'id recorded it, saying: Isma'il ibn 'Ayyash narrated to me from 'Amr ibn Qays al-Ma'ribi (10) from his father, from Abyad ibn Hammal al-Ma'ribi (11) who said: I requested from the Messenger of Allah (peace and blessings of Allah be upon him) the salt mine
